Assembly Resolution No. 715

in relation to the election and seating of Brian
A. Cunningham as a Member of the Assembly from the
43rd Assembly District

WHEREAS, There is a vacancy existing in the membership of this
House, which was filled at the election held on March 22, 2022; and

WHEREAS, The final official canvass of the votes cast at said
election and certification thereof of the person elected thereat, cannot
be made at this time; and

WHEREAS, The Board of Elections of the City of New York has advised
that the votes cast for the Office of Member of Assembly in the 43rd
Assembly District in the County of Kings shown by its canvass were
respectively as follows: Brian A. Cunningham, Democrat, one thousand
eight hundred and sixty-nine, Mesidor Azor, Republican and Conservative,
eighty-eight; Jelanie Deshong, Working Families, one thousand and
thirty-six; and

WHEREAS, It appears that the results of the votes cast in said
Assembly District cannot be affected by the final official canvass of
such voters; and

WHEREAS, Brian A. Cunningham has duly taken an oath of office as a
Member of Assembly; now, therefore, be it

RESOLVED, That Brian A. Cunningham, Democrat, is duly elected and
qualified as a Member of the Assembly for his respective district and
that he be seated in this House as such Member.
