BILL NUMBER: S5635 SPONSOR: WEBB TITLE OF BILL: An act to amend the education law, in relation to authorizing pharma- cists to administer injections for contraceptive use PURPOSE: To authorize pharmacists to administer injections for contraceptive use. SUMMARY OF PROVISIONS: Section 1 amends section 6527 of the education law adding a new subdivi- sion 7-b to allow pharmacists to administer the injection of hormones approved by the United States Food and Drug Administration (USFDA) for contraceptive use followed by an order from a licensed physician. Section 2 amends subdivision 22 of section 6802 of the education law by adding a new paragraph c to include injections for contraceptive use, approved by the USFDA, to the list of injections pharmacists may admin-

WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to authorizing pharma- cists to administer injections for contraceptive use THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6527 of the education law is amended by adding a new subdivision 7-b to read as follows: 7-B. A LICENSED PHYSICIAN MAY PRESCRIBE AND ORDER A PATIENT SPECIFIC ORDER OR A NON-PATIENT SPECIFIC ORDER TO A LICENSED PHARMACIST, PURSUANT TO REGULATIONS PROMULGATED BY THE COMMISSIONER IN CONSULTATION WITH THE COMMISSIONER OF HEALTH, AND CONSISTENT WITH THE PUBLIC HEALTH LAW, FOR THE ADMINISTRATION OF INJECTIONS OF A HORMONE OR A COMBINATION OF HORMONES THAT IS APPROVED BY THE UNITED STATES FOOD AND DRUG ADMINIS- TRATION FOR THE PURPOSE OF CONTRACEPTIVE USE. § 2. Subdivision 22 of section 6802 of the education law is amended by adding a new paragraph c to read as follows: C. THE INJECTION OF A HORMONE OR A COMBINATION OF HORMONES THAT IS APPROVED BY THE UNITED STATES FOOD AND DRUG ADMINISTRATION FOR THE PURPOSE OF CONTRACEPTIVE USE, AS PRESCRIBED OR ORDERED BY A LICENSED PRESCRIBER, ACTING WITHIN THE SCOPE OF THEIR PRACTICE IN THIS STATE AND IN ACCORDANCE WITH REGULATIONS PROMULGATED BY THE COMMISSIONER IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, AND CONSISTENT WITH THE PUBLIC HEALTH LAW. § 3. Section 6801 of the education law is amended by adding a new subdivision 9 to read as follows: 9. A LICENSED PHARMACIST WITHIN THEIR LAWFUL SCOPE OF PRACTICE MAY ADMINISTER INJECTABLE MEDICATIONS OF A HORMONE OR A COMBINATION OF HORMONES THAT IS APPROVED BY THE UNITED STATES FOOD AND DRUG ADMINIS- TRATION FOR THE PURPOSE OF CONTRACEPTIVE USE, PURSUANT TO SECTION SIX THOUSAND EIGHT HUNDRED TWO OF THIS ARTICLE, AS PRESCRIBED OR ORDERED BY EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. A licensed physician may prescribe and order a non-patient specif- ic order to a pharmacist licensed and located in the state, pursuant to regulations promulgated by the commissioner, and consistent with section sixty-eight hundred one of this title, for dispensing self-administered hormonal contraceptives OR ADMINISTERING A UNITED STATES FOOD AND DRUG ADMINISTRATION APPROVED REVERSIBLE PROGESTIN-ONLY CONTRACEPTIVE INJECTION as defined in section sixty-eight hundred two of this title. § 2. Subdivision 9 of section 6801 of the education law, as added by chapter 128 of the laws of 2023, is amended to read as follows: 9. a. A licensed pharmacist may execute a non-patient specific order for the dispensing of self-administered hormonal contraceptives OR ADMINISTER A UNITED STATES FOOD AND DRUG ADMINISTRATION REVERSIBLE PROGESTIN-ONLY CONTRACEPTIVE INJECTION prescribed or ordered by the commissioner of health, a physician licensed in this state or a nurse practitioner certified in this state pursuant to rules and regulations promulgated by the commissioner. b. Prior to dispensing self-administered hormonal contraceptives OR ADMINISTERING A UNITED STATES FOOD AND DRUG ADMINISTRATION REVERSIBLE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
