2025-S7153 (ACTIVE) - Summary

Directs the department of economic development, in conjunction with the empire state development corporation, to review all contracts entered into or overseen or enforced by the department of economic development and/or the empire state development corporation relating to the leasing of state-owned premises to private parties for the production, manufacture and/or development of solar shingle products, electric vehicle charging networks, advanced driver-assistance systems, and/or supercomputer hardware and to identify and eliminate fraud, abuse or waste by private parties.

TITLE OF BILL:

An act to amend the economic development law, in relation to enacting
the "New York Determining Obligations and Guaranteeing Enforcement
(DOGE) in Government Contracting Act"

 
PURPOSE:

To require an investigation of all existing contracts relating to the
leasing of state-owned premises to private parties for the production,
manufacture and/or development of solar shingle products, electric vehi-
cle charging networks, advanced driver-assistance systems, and/or super-
computer hardware in the spirit of "DOGE", in order to: (a) eliminate
any waste, fraud, or abuse of New York State resources by private
parties to the agreements; and (b) maximize governmental efficiency and
productivity by holding those private parties accountable.

 
SUMMARY OF PROVISIONS:

Section one of the bill names it the "New York Determining Obligations
and Guaranteeing Enforcement (DOGE) in Government Contracting Act."

Section two of the bill requires Empire State Development to conduct a
"DOGE" audit of all existing state contracts relating to the leasing of
state-owned premises to private parties for the production, manufacture
and/or development of solar shingle products, electric vehicle charging
networks, advanced driver-assistance systems, and/or supercomputer hard-
ware. Specifically, Empire State Development will be required to identi-
fy and stop waste, fraud, and abuse committed by private parties to the
contracts in order to maximize governmental efficiency and productivity,
and also confirm whether the private parties have created promised jobs,
invested in promised supercomputers, opened promised dealerships, and
paid for promised leased space. Empire State Development will be
required to deliver a report supported by documents and data to the
Governor and Legislature within 60 days, and take remedial action within
90 days.  In the event Empire State Development seeks to claw back
public monies paid to private parties, Empire State Development will be
required to invest such monies in local workforce development or econom-
ic development programs benefiting the impacted community.

Section three of the bill relates to the effective date.

 
JUSTIFICATION:

New York should heed the call of the federal government and its
unelected, unauthorized advisors to "investigate waste, fraud and abuse"
of state government resources. There is no better place to start than
the state's leasing of state-owned premises to private parties for the
production, manufacture and/or development of solar shingle products,
electric vehicle charging networks, advanced driver-assistance systems,
and/or supercomputer hardware.

According to news reports, private parties to these contracts are the
beneficiaries of significant state investment and yet they squander
state money without delivering on their promises. As just one example,
Tesla operates a factory in New York State out of a state-owned facili-
ty. As part of the agreement to use that state owned facility they are
required to meet certain standards in terms of employment and invest-
ments in New York State. Tesla is allegedly not meeting these contractu-
al obligations without consequences.

The New York DOGE in Government Contracting Act will take these nefari-
ous private parties to account by requiring a systemic audit of related
government contracts. The audit will - unlike federal DOGE's opaque and
discredited methodology - be supported by documents and data, and follow
the law in requiring the state to hold private parties up to their
contractual obligations.

This legislation seeks to hold - among others - Elon Musk and Tesla
accountable by requiring a thorough examination of the business dealings
that New York State has with parties like Tesla to determine if they
actually are doing what they promised in terms of job creation, invest-
ments in supercomputers, opening new dealerships and payment of their
leases. If they have not, then our legislation will require New York
State to take any measures necessary to terminate our contracts with
parties like Tesla and get back any funds that parties like Tesla may
have improperly taken from New Yorkers, and redistribute that money to
impacted communities.

It thus may be the case Elon Musk is doing enormous damage under the
pretense of cutting waste, while benefiting from one of the biggest and
worst government subsidy deals in the history of New York. This legis-
lation is about fighting back --- both against this alleged actual waste
of taxpayer dollars by Elon Musk himself and against a regime that is
directly hostile to the interests of New York.

 AN  ACT  to  amend the economic development law, in relation to enacting
   the "New York Determining  Obligations  and  Guaranteeing  Enforcement
   (DOGE) in Government Contracting Act"
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Short title. This act shall be known and may  be  cited  as
 the  "New  York  Determining  Obligations  and  Guaranteeing Enforcement
 (DOGE) in Government Contracting Act".
   § 2. The economic development law is amended by adding a  new  article
 28 to read as follows:
 
                                ARTICLE 28
    DETERMINING OBLIGATIONS AND GUARANTEEING ENFORCEMENT IN GOVERNMENT
                                CONTRACTING
 
 SECTION 500. DETERMINING  OBLIGATIONS  AND  GUARANTEEING  ENFORCEMENT IN
                GOVERNMENT CONTRACTING.
   § 500. DETERMINING OBLIGATIONS AND GUARANTEEING ENFORCEMENT IN GOVERN-
 MENT CONTRACTING. 1. THE DEPARTMENT,  IN  CONJUNCTION  WITH  THE  EMPIRE
 STATE   DEVELOPMENT  CORPORATION,  IS  HEREBY  DIRECTED  TO  REVIEW  ALL
 CONTRACTS ENTERED INTO OR OVERSEEN OR  ENFORCED  BY  THE  DEPARTMENT  OF
 ECONOMIC  DEVELOPMENT  AND/OR  THE  EMPIRE STATE DEVELOPMENT CORPORATION
 RELATING TO THE LEASING OF STATE-OWNED PREMISES TO PRIVATE  PARTIES  FOR
 THE   PRODUCTION,   MANUFACTURE  AND/OR  DEVELOPMENT  OF  SOLAR  SHINGLE
 PRODUCTS, ELECTRIC VEHICLE CHARGING NETWORKS, ADVANCED DRIVER-ASSISTANCE
 SYSTEMS, AND/OR SUPERCOMPUTER HARDWARE.
   2. IN REVIEWING SUCH CONTRACTS, THE DEPARTMENT SHALL IDENTIFY AND STOP
 WASTE, FRAUD, AND ABUSE COMMITTED BY PRIVATE PARTIES TO THE CONTRACTS IN

 ORDER TO MAXIMIZE GOVERNMENTAL EFFICIENCY AND PRODUCTIVITY. IN ADDITION,
 THE DEPARTMENT SHALL ANALYZE AND DETERMINE WHETHER  PRIVATE  PARTIES  TO
 SUCH CONTRACTS:
   (A) EMPLOY SUFFICIENT PERSONS WITHIN THE STATE;
   (B)  PAY  SUFFICIENT  RENT  FOR  THE USE OF LEASED PREMISES WITHIN THE
 STATE;
   (C) LOCATE AND  INVEST  IN  SUFFICIENT  RESOURCES  WITHIN  THE  STATE,
 INCLUDING BUT NOT LIMITED TO SUPERCOMPUTERS;
   (D) INVEST SUFFICIENTLY IN JOB TRAINING PROGRAMS WITHIN THE STATE; AND
   (E) OPERATE SUFFICIENT RETAIL LOCATIONS WITHIN THE STATE.
   3.  WITHIN  SIXTY  DAYS  OF  THE  EFFECTIVE  DATE OF THIS SECTION, THE
 DEPARTMENT SHALL  DELIVER  A  REPORT  DOCUMENTING  ITS  REVIEW  OF  SUCH
 CONTRACTS  TO  THE  GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE
 SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER  OF  THE  SENATE,  AND  THE
 MINORITY  LEADER  OF  THE ASSEMBLY. THE REPORT SHALL IDENTIFY AND ATTACH
 THE REVIEWED CONTRACTS, BE SUPPORTED WITH DOCUMENTS AND  DATA,  AND  FOR
 EACH CONTRACT:
   (A)  IDENTIFY  WASTE,  FRAUD AND ABUSE COMMITTED BY PRIVATE PARTIES TO
 THE CONTRACT;
   (B) STATE ACTIONS THE DEPARTMENT INTENDS TO TAKE TO REMEDY  IDENTIFIED
 WASTE, FRAUD, AND ABUSE COMMITTED BY PRIVATE PARTIES TO THE CONTRACT;
   (C)  DETERMINE WHETHER PRIVATE PARTIES TO THE CONTRACT MEET BENCHMARKS
 SET FORTH IN THE CONTRACT AS TO THE FACTORS  DELINEATED  IN  SUBDIVISION
 TWO OF THIS SECTION; AND
   (D) STATE ACTIONS THE DEPARTMENT INTENDS TO TAKE TO REMEDY FAILURES OF
 PRIVATE  PARTIES  TO  THE  CONTRACT  TO MEET BENCHMARKS SET FORTH IN THE
 CONTRACT AS TO  THE  FACTORS  DELINEATED  IN  SUBDIVISION  TWO  OF  THIS
 SECTION.
   4.  WITHIN  NINETY  DAYS  OF  THE  EFFECTIVE DATE OF THIS SECTION, THE
 DEPARTMENT SHALL INITIATE ANY REMEDIAL ACTION IDENTIFIED IN  SUBDIVISION
 THREE OF THIS SECTION, INCLUDING BUT NOT LIMITED TO:
   (A)  TERMINATION  OF CONTRACTS WITH PRIVATE PARTIES THAT COMMIT WASTE,
 FRAUD, AND ABUSE AGAINST THE STATE OF NEW YORK;
   (B) LEVYING OF FINES AGAINST PRIVATE PARTIES PURSUANT TO THE TERMS  OF
 CONTRACTS;
   (C) ACTION TO CLAW BACK MONIES PAID TO PRIVATE PARTIES NOTWITHSTANDING
 THEIR BREACH OF CONTRACTS; AND
   (D) EVICTION PROCEEDINGS AGAINST PRIVATE PARTIES.
   5.  IN  THE  EVENT  THAT THE DEPARTMENT INITIATES ANY REMEDIAL ACTIONS
 IDENTIFIED IN PARAGRAPH (C) OF SUBDIVISION FOUR  OF  THIS  SECTION,  ANY
 FUNDS  SAVED AS A RESULT OF SUCH REMEDIAL ACTIONS SHALL BE REINVESTED IN
 LOCAL WORKFORCE DEVELOPMENT OR ECONOMIC DEVELOPMENT PROGRAMS BENEFITTING
 THE IMPACTED COMMUNITY.
   § 3. This act shall take effect immediately.
