BILL NUMBER: S7165 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the public service law, in relation to authorizing consideration of non-economic loss suffered by consumers when determin- ing penalties PURPOSE:: This bill authorizes the public service commission to consider non-eco- nomic losses suffered by consumers in issuing penalties, including nego- tiated settlements, with SUMMARY OF PROVISIONS:: Section 1 amends public service law section 25 to authorize the public service commission to consider non-economic tosses such as pain and suffering or mental anguish in determining penalties, including negoti- ated settlements, between the PSC and public utility corporations, for violations of existing Law.

Section 25 of the public service law is amended by adding a new subdivision 8 to read as follows: 8. IN DETERMINING PENALTIES PURSUANT TO THIS SECTION, INCLUDING ANY NEGOTIATED SETTLEMENTS BETWEEN THE COMMISSION AND A PUBLIC UTILITY COMPANY, CORPORATION OR PERSON AND THE OFFICERS, AGENTS AND EMPLOYEES THEREOF, THE COMMISSION MAY CONSIDER NON-ECONOMIC LOSS SUFFERED BY CONSUMERS INCLUDING, BUT NOT LIMITED TO, PAIN AND SUFFERING OR MENTAL ANGUISH. § 2. Section 25-a of the public service law is amended by adding a new subdivision 12 to read as follows: 12. IN DETERMINING PENALTIES PURSUANT TO THIS SECTION, INCLUDING ANY NEGOTIATED SETTLEMENTS BETWEEN THE COMMISSION AND A COMBINATION GAS AND ELECTRIC CORPORATION OR THE OFFICERS THEREOF, THE COMMISSION MAY CONSID- ER NON-ECONOMIC LOSS SUFFERED BY CONSUMERS, INCLUDING BUT NOT LIMITED TO, PAIN AND SUFFERING OR MENTAL ANGUISH. § 3.
