TITLE OF BILL:

An act to amend the insurance law, in relation to providing health
insurance coverage for scalp cooling for the preservation of hair during
cancer chemotherapy treatment

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill would ensure coverage of scalp cooling devices to preserve
hair during chemotherapy treatment.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1. Amends Subsection (i) of section 3216 of the insurance law by
adding a new paragraph 12-b. This requires that every policy issued in
the state for medical, major medical, or comprehensive health insurance
and also for chemotherapy treatments must provide coverage for scalp
cooling. That this could be subject to co-pays, coinsurance or deduct-
ibles that apply to coverage for intravenous or injected anticancer

medications. Defining "scalp cooling" as cooling cap, hypothermia cap,
cold cap or any other device used as a therapeutic device to cool the
human scalp to prevent or reduce hair loss during chemotherapy.

Section 2. Amends subsection (1) of section 3221 of the insurance law by
adding a new paragraph 12-b as defined in section 1.

Section 3. Amends section 4303 of the insurance law by adding a new
subsection (q-2), as defined in section 1.

Section 4. Sets forth the effective date.

 
JUSTIFICATION:

Hair loss can be one of the most noticeable and devastating effects of
cancer treatment. For many women, hair loss during cancer treatment can
be debilitating and interfere with their treatment and recovery.  The
side effect of hair loss creates a constant reminder of the disease and
can heighten one's feelings of loss and sadness during an already diffi-
cult process.

Chemotherapy attacks cancer cells, but can also kill other cells in the
body, including those in hair roots. Scalp cooling is a preventive mech-
anism that has been able to reduce and prevent chemotherapy-induced hair
loss. The devices used in scalp cooling restrict blood vessels in the
scalp, limiting the amount of chemo that reaches hair follicle cells.
This bill would require health insurance companies to provide coverage
for patients to access scalp cooling for hair preservation while under-
going chemotherapy treatment.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
 amended by adding a new paragraph 12-b to read as follows:
   (12-B) (A) EVERY POLICY DELIVERED OR ISSUED FOR DELIVERY IN THIS STATE
 THAT PROVIDES MEDICAL,  MAJOR  MEDICAL,  OR  SIMILAR  COMPREHENSIVE-TYPE
 COVERAGE  AND PROVIDES COVERAGE FOR PRESCRIPTION DRUGS AND ALSO PROVIDES
 COVERAGE FOR CANCER CHEMOTHERAPY TREATMENT SHALL  PROVIDE  COVERAGE  FOR
 SCALP  COOLING.  SUCH COVERAGE MAY BE SUBJECT TO CO-PAYS, COINSURANCE OR
 DEDUCTIBLES, PROVIDED THAT THE CO-PAYS, COINSURANCE OR  DEDUCTIBLES  ARE
 AT  LEAST  AS  FAVORABLE  TO  AN  INSURED AS THE CO-PAYS, COINSURANCE OR
 DEDUCTIBLES THAT APPLY TO COVERAGE FOR INTRAVENOUS OR INJECTED  ANTICAN-
