BILL NUMBER:A10522 TITLE OF BILL: An act to amend the New York state printing and public documents law, in relation to the letting of contracts for printing PURPOSE: This bill "synchronizes" bidding limits in the State Printing and Public Documents Law with the limits in the state Finance Law. SUMMARY OF PROVISIONS: Amends section 3, subdivision S of the State printing and Public Docu- ments Law to repeal 15-year-old contract bidding limits, and to replace these by cross reference to the commodity contract bidding limits contained in section 163 of the state Finance Law. EXISTING LAW: Currently, the State Printing and Public Documents Law permits State departments and agencies to make open market purchases of printing up to $5,000 per purchase. The State Finance Law, however, permits purchases of all other commodities up to $50,000. JUSTIFICATION: The state Printing and Public Documents Law has been periodically updated to conform to amendments to the state Finance Law in regard to bidding limits. The last update was in 1991. TEDISCO -- read once and referred to the Commit- tee on Governmental Employees AN ACT to amend the New York state printing and public documents law, in relation to the letting of contracts for printing THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 3 of the New York state printing and public documents law, as amended by chapter 346 of the laws of 1991, is amended to read as follows: 5. Notwithstanding any of the foregoing provisions of this section, or of any general or special act, the commissioner AND OTHER STATE AGENCIES AND DEPARTMENTS may contract for printing to an amount not exceeding [ten thousand dollars] THE LIMIT SET FOR THE COMMISSIONER OF GENERAL SERVICES AND STATE AGENCIES, RESPECTIVELY, PURSUANT TO SUBDIVISION SIX OF SECTION ONE HUNDRED SIXTY-THREE OF THE STATE FINANCE LAW without competitive bidding[, and may by rule prescribing the amount, not exceeding five thousand dollars, authorize other state departments and agencies to let contracts, without competitive bidding, for printing required by them. Such rule]. THE COMMISSIONER shall prescribe the form, manner and content of the notice to be given to prospective vendors, the form of specifications and proposals for such printing, and the method used in making an award WITHOUT COMPETITIVE BIDDING PURSUANT TO THIS SUBDIVISION, except that as such specifications relate to the paper required for printing they shall be in accordance with those established pursuant to section one hundred [sixty-four] SIXTY-FIVE of the state finance law. Multiple purchases of identical items of printing and printing supplies, made by such other department or agency without competitive bidding within a period of sixty days, shall not exceed the [sum of five thousand dollars] LIMIT SET FOR STATE AGENCIES PURSUANT TO SUBDIVISION SIX OF SECTION ONE HUNDRED SIXTY-THREE OF THE STATE FINANCE LAW.
