BILL NUMBER:A10574 TITLE OF BILL: An act to amend the public health law, in relation to prohibiting the use or sale of food products made with high-fructose corn syrup PURPOSE OR GENERAL IDEA OF BILL: To prohibit the sale, storage, distribution, or use of food products made with high-fructose corn syrup in the preparation of any food product to be served or sold in restau- rants, food service establishments, or retail food stores. JUSTIFICATION: High-fructose corn syrup (HFCS) is a commonly-used sweetener and preservative made by changing the sugar (glucose) in cornstarch to fructose to create a combination of glucose and fructose. HFCS is frequently used instead of sugar alone in the preparation of commercially sold food products because it extends the shelf life of processed foods and is less expensive to use than sugar. Recent research has linked HFCS to health issues such as obesity, insulin resistance, and liver disease. Longterm consumption of HFCS has been linked to the presence of liver scarring indicative of liver damage, as well as increases in body fat and blood triglyceride levels which are related to known risk factors for high blood pressure, coronary artery disease, cancer and diabetes. By prohibiting the sale, storage, distribution, or use of food products made with HFCS, this bill will help to decrease the incidence of diseases related to HFCS consumption and will promote public health.

CLARK -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to prohibiting the use or sale of food products made with high-fructose corn syrup THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 1352-d to read as follows: S 1352-D. HIGH-FRUCTOSE CORN SYRUP; PROHIBITION. NO FOOD ITEM OR PROD- UCT CONTAINING HIGH-FRUCTOSE CORN SYRUP SHALL BE SOLD, STORED, DISTRIB- UTED, HELD FOR SERVICE, OR USED IN PREPARATION OF ANY FOOD PRODUCT TO BE SERVED OR SOLD IN ANY RESTAURANTS, FOOD SERVICE ESTABLISHMENTS, RETAIL FOOD STORES AS DEFINED IN SECTION FIVE HUNDRED OF THE AGRICULTURE AND MARKETS LAW, AND OTHER FOOD ESTABLISHMENTS. THE COMMISSIONER IS AUTHOR- IZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. S 2. This act shall take effect immediately.
