2009-A2717 (ACTIVE) - Summary
Provides a tax credit for the purchase of a programmable thermostat; defines "programmable thermostat" to mean a device attached to the heating and cooling system of a residence designed to automatically adjust the temperature to conserve energy; such credit shall be in the amount of fifteen dollars or less.

JAFFEE, CAHILL, SPANO -- Multi-Sponsored by -- M. of A. COLTON, DINOWITZ -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to a tax credit for the purchase of a programmable thermostat THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 606 of the tax law is amended by adding a new subsection (qq) to read as follows: (QQ) PROGRAMMABLE THERMOSTAT CREDIT. (1) AN INDIVIDUAL TAXPAYER SHALL BE ALLOWED A CREDIT AGAINST THE TAX IMPOSED BY THIS ARTICLE FOR THE PURCHASE OF A PROGRAMMABLE THERMOSTAT DURING THE TAXABLE YEAR. THIS CREDIT FOR ANY TAXABLE YEAR SHALL NOT EXCEED FIFTEEN DOLLARS. (2) FOR THE PURPOSES OF THIS SECTION, THE TERM "PROGRAMMABLE THERMO- STAT" SHALL MEAN A DEVICE ATTACHED TO THE HEATING AND COOLING SYSTEM OF A RESIDENCE DESIGNED TO AUTOMATICALLY ADJUST THE TEMPERATURE TO CONSERVE ENERGY. S 2. This act shall take effect immediately and shall apply to taxable years commencing on and after such date.
