2009-A5349 (ACTIVE) - Summary

Enacts the highway safety act of 2009 which requires that all examinations for licenses be conducted in English, no interpreters may be used during examination and that applicants for driver's license must be able to read and speak English sufficiently to understand highway signs and signals.

AN ACT to amend the vehicle and traffic law, in relation to creating the
  highway safety act of 2009

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Short title. This act shall be known and may  be  cited  as
the "highway safety act of 2009".
  S  2.  Subdivision  4 of section 502 of the vehicle and traffic law is
amended by adding a new paragraph (h) to read as follows:
  (H) LANGUAGE. (I)  ALL  EXAMINATIONS  ADMINISTERED  PURSUANT  TO  THIS
SECTION, WHETHER WRITTEN OR OTHERWISE, SHALL BE CONDUCTED EXCLUSIVELY IN
THE ENGLISH LANGUAGE.
  (II)  THE DEPARTMENT SHALL NEITHER SUPPLY NOR PERMIT THE USE OF INTER-
PRETERS IN CONNECTION WITH CONDUCTING EXAMINATIONS OF  APPLICANTS  UNDER
THIS SECTION.
  (III)  AN  APPLICANT FOR A DRIVER'S LICENSE UNDER THIS SECTION MUST BE
ABLE TO READ AND SPEAK THE ENGLISH  LANGUAGE  SUFFICIENTLY  TO  CONVERSE
WITH THE GENERAL PUBLIC, UNDERSTAND HIGHWAY TRAFFIC SIGNS AND SIGNALS IN
THE ENGLISH LANGUAGE, RESPOND TO OFFICIAL INQUIRIES, AND MAKE ENTRIES ON
REPORTS AND RECORDS.
  S 3. This act shall take effect on the one hundred eightieth day after
it  shall  have  become a law; provided, however, that the department of
motor vehicles shall promulgate any rules and regulations necessary  for
the timely implementation of this act on or before such effective date.
