DUPREY, GIGLIO, McKEVITT, QUINN, REILLY, SAYWARD, TEDISCO, THIELE, WALKER -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to absentee voting THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 8-400 of the election law is amended by adding a new subdivision 10 to read as follows: 10. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A QUALIFIED VOTER IN ANY VILLAGE, TOWN OR CITY MAY VOTE IN ANY SPECIAL ELECTION OR ON A LOCAL REFERENDUM OR ANY QUALIFIED VOTER OF A SCHOOL OR FIRE DISTRICT MAY VOTE IN ANY DISTRICT ELECTION OR ON A LOCAL REFERENDUM BY ABSENTEE BALLOT PURSUANT TO THE PROVISIONS OF THIS SECTION. THE LIST OF REGISTERED VOTERS IF SO REQUESTED BY THE VILLAGE, TOWN, CITY, SCHOOL DISTRICT OR FIRE DISTRICT SHALL BE FURNISHED BY THE RESPECTIVE BOARD OF ELECTIONS AND NEED NOT BE COMPILED BY THE AFORESAID VOTING UNIT. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law. BILL NUMBER:A5626A TITLE OF BILL: An act to amend the election law, in relation to absen- tee voting PURPOSE OR GENERAL IDEA OF BILL: To provide for absentee voting for municipalities, school and fire districts on local elections. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 8-400 of the election law by adding a new Subdivision 11 A qualified voter in any village, town, city, or school or fire district may vote in any special election, district election or local referendum by absentee ballot pursuant to this section. JUSTIFICATION: Voting is a fundamental right and responsibility in our shared democra- cy. Access to this right should not be obstructed or denied because a chosen election is not administered by a county board of elections. The decision to hold special elections or public referenda on a date other than those already established should not prohibit the use of absentee ballots. Therefore this legislation would require absentee ballot access for all elections in the State of New York, special or otherwise.
