AN  ACT  to  amend  the  environmental  conservation law, in relation to
  prohibiting marine solid waste transfer stations located in  proximity
  to public housing projects in certain cases

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The environmental conservation law is amended by  adding  a
new section 27-0721 to read as follows:
S 27-0721. MARINE SOLID WASTE TRANSFER STATION OR FACILITIES.
  NOTWITHSTANDING  ANY  INCONSISTENT  PROVISION OF STATE OR LOCAL LAW OR
REGULATION, NEITHER THE DEPARTMENT NOR ANY LOCAL AGENCY,  DEPARTMENT  OR
AUTHORITY SHALL ISSUE A PERMIT, REGULATION, OR RENEW A PERMIT OR APPROVE
AN APPLICATION FOR THE EXPANSION, CONSTRUCTION, RELOCATION, REACTIVATION
OR  OPERATION  OF A MARINE SOLID WASTE TRANSFER STATION OR FACILITY IN A
CITY WITH A POPULATION OF ONE MILLION OR MORE, WHERE ANY  PART  OF  SUCH
STATION  OR  FACILITY  IS  TO  BE LOCATED WITHIN EIGHT HUNDRED FEET OF A
HOUSING PROJECT AS THE TERM PROJECT IS DEFINED IN  SUBDIVISION  FOURTEEN
OF SECTION THREE OF THE PUBLIC HOUSING LAW.
  S 2. This act shall take effect immediately.
