AN  ACT to amend the elder law, in relation to establishing a program to
  encourage retirees to make their homes in New York state

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The elder law is amended by adding a new section 209-a to
read as follows:
  S 209-A. NEW YORK CERTIFIED RETIREMENT COMMUNITY PROGRAM. 1.  FOR  THE
PURPOSES  OF  THIS  SECTION, "CERTIFIED RETIREMENT COMMUNITY" SHALL MEAN
ANY CITY, TOWN, VILLAGE,  OR  PORTION  THEREOF,  THAT  CONTAINS  OR  HAS
CONVENIENTLY  AVAILABLE  THOSE  AMENITIES THAT ARE OF PARTICULAR NEED OR
INTEREST TO PERSONS WHO ARE RETIRED OR WHO PLAN TO RETIRE, AND HAS  BEEN
SO  DESIGNATED  BY THE DIRECTOR OF THE OFFICE FOR THE AGING. SUCH DESIG-
NATION SHALL BE FOR A DURATION OF NOT LESS THAN FIVE YEARS, AND  MAY  BE
RENEWED THEREAFTER BY MAKING APPLICATION TO SUCH DIRECTOR.
  2. THE DIRECTOR OF THE OFFICE FOR THE AGING SHALL, WITHIN SUCH OFFICE,
ESTABLISH A NEW YORK CERTIFIED RETIREMENT COMMUNITY PROGRAM. THE PURPOSE
OF SUCH PROGRAM SHALL BE TO:
  (A)  PROMOTE  THE  CITIES,  TOWNS,  VILLAGES  AND  PORTIONS THEREOF AS
RETIREMENT  DESTINATIONS  TO  RETIREES  AND  PROSPECTIVE  RETIREES,  FOR
PURPOSES  OF  COMMUNITY  AND  ECONOMIC  DEVELOPMENT,  AND  AS A MEANS OF
ENRICHING THE STATE AND ITS COMMUNITIES; AND
  (B) ASSIST SUCH  CITIES,  TOWNS,  VILLAGES  AND  PORTIONS  THEREOF  IN
PROVIDING AMENITIES THAT RETIREES WOULD FIND ATTRACTIVE.
  3.  THE  DIRECTOR  OF  THE  OFFICE FOR THE AGING SHALL ADOPT RULES AND
REGULATIONS PROVIDING FOR THE MANNER IN WHICH A CITY, TOWN,  VILLAGE  OR
PORTION  THEREOF  MAY BE DESIGNATED AND RETAIN ITS STATUS AS A CERTIFIED
RETIREMENT COMMUNITY. WHEN ADOPTING SUCH  RULES  AND  REGULATIONS,  SUCH
DIRECTOR  SHALL CONSULT WITH THE DEPARTMENT OF ECONOMIC DEVELOPMENT, THE

AN  ACT to amend the elder law, in relation to establishing a program to
  encourage retirees to make their homes in New York state

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Short  title. This act shall be known and may be cited as
the "New York certified  retirement  community  act,"  and  the  program
created  hereunder  shall  be  known as the "New York Livable Integrated
Elder Friendly Retirement Communities (New York LIFE) program."
  S 2. Section 301 of the elder law is designated  title  1  and  a  new
title heading is added to read as follows:

  S  3. Article 3 of the elder law is amended by adding a new title 2 to
read as follows:
