LUPARDO -- read once and referred to the Commit- tee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the New York state oil and natural gas advisory board THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The section heading and subdivisions 1 and 2 of section 23-0311 of the environmental conservation law, the section heading as added by chapter 846 of the laws of 1981 and subdivisions 1 and 2 as amended by chapter 83 of the laws of 1995, are amended to read as follows: New York state oil[,] AND NATURAL gas [and solution mining] advisory board. 1. A [thirteen] FIFTEEN member New York state oil[,] AND NATURAL gas [and solution mining] advisory board shall be created within the depart- ment to advise and assist the commissioner and other state agencies on activities and policies related to the development, operation and regu- lation of the oil[,] AND NATURAL gas [and solution mining] industry. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, DISCUSSIONS AND RECOMMENDA- TIONS ON THE BEST PRACTICES OF THE INDUSTRY, PROTECTION OF WATER SUPPLIES AND RELATED TOPICS. The members shall be appointed by the governor, with a majority representative of the respective industries, PROVIDED, HOWEVER, THAT AT LEAST THREE OF THE MEMBERS ARE EITHER (A) LANDOWNERS WITH A CURRENT NATURAL GAS OR OIL LEASE OR (B) REPRESEN- TATIVES OF A MUNICIPALITY IN WHICH THERE IS CURRENT OIL OR NATURAL GAS EXPLORATION OR DRILLING BEING PERFORMED. Three of the members shall be appointed upon recommendation of the majority leader of the senate[and], three of the members shall be appointed upon recommendation of the speaker of the assembly, ONE MEMBER SHALL BE APPOINTED UPON RECOMMENDA- TION OF THE MINORITY LEADER OF THE SENATE AND ONE MEMBER SHALL BE APPOINTED UPON RECOMMENDATION OF THE MINORITY LEADER OF THE ASSEMBLY. BILL NUMBER:A7918A TITLE OF BILL: An act to amend the environmental conservation law, in relation to the New York state oil, natural gas and solution mining advisory board PURPOSE OR GENERAL IDEA OF BILL: This bill seeks to reinvigorate the New York State Oil, Gas and Solution Mining Advisory Board. SUMMARY OF SPECIFIC PROVISIONS: Amends subdivisions I and 2 of section 23-0311 of the Environmental Conservation Law to: expand membership from thirteen members to fifteen members; provide that the board discuss and provide recommendations on, among other things, the best practices of the industry, protection of water supplies and other related topics; provides for appointments from the minority leaders of the Senate and Assembly; Includes the Commissioner of the Department of Agriculture and Markets as an ex-officio member of the board. JUSTIFICATION: Clearly, natural gas exploration and drilling will be on the increase in New York State in the coming years and we must be sure that there is an active and engaged group of industry, land owner and municipal representatives who are discussing and making recommendations to the Department of Environmental Conservation on needed regulations and programs.
