ORTIZ, ESPAILLAT, LAVINE -- Multi-Sponsored by -- M. of A. ALFANO, DIAZ, GALEF, MAGEE, MAYERSOHN -- read once and referred to the Committee on Codes AN ACT to amend the penal law and the executive law, in relation to establishing the crime of criminal sale of an internet domain name to a terrorist group THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 490.60 to read as follows: S 490.60 CRIMINAL SALE OF AN INTERNET DOMAIN NAME TO A TERRORIST GROUP. A PERSON IS GUILTY OF CRIMINAL SALE OF AN INTERNET DOMAIN NAME TO A TERRORIST GROUP WHEN HE OR SHE KNOWINGLY SELLS OR PROVIDES WITHOUT CHARGE AN INTERNET DOMAIN NAME TO ANY ORGANIZATION INCLUDED ON THE LIST OF ORGANIZATIONS ENGAGED IN TERRORIST ACTIVITIES OR WHO POSE A TERRORIST THREAT COMPILED, MAINTAINED AND UPDATED BY THE STATE OFFICE OF HOMELAND SECURITY PURSUANT TO PARAGRAPH (T) OF SUBDIVISION TWO OF SECTION SEVEN HUNDRED NINE OF THE EXECUTIVE LAW. CRIMINAL SALE OF AN INTERNET DOMAIN NAME TO A TERRORIST GROUP IS A CLASS A MISDEMEANOR. S 2. Paragraphs (q), (r) and (r) of subdivision 2 of section 709 of the executive law, paragraph (q) as separately amended by chapters 537 and 620 of the laws of 2005, paragraph (r) as added by chapter 537 of the laws of 2005 and paragraph (r) as added by chapter 620 of the laws of 2005, are amended, and a new paragraph (t) is added to read as follows: (q) request from any department, division, office, commission or other agency of the state or any political subdivision thereof, and the same are authorized to provide, such assistance, services and data as may be required by the office of homeland security in carrying out the purposes EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
