WRIGHT -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to financial contributions by recipients of temporary housing assistance and discontinuance of temporary housing assistance based on a recipient's actions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 131-a of the social services law, as amended by section 12 of part B of chapter 436 of the laws of 1997, is amended to read as follows: 7. (A) Whenever a social services official finds that a recipient of public assistance has failed to fully apply the amount allowed in his grant for shelter to the payment of rent for his housing accommodations, unless rent is being withheld pursuant to law or court order, the social services official shall furnish such recipient's shelter allowance in the form of direct payments to the owner of such housing accommodations or his or her designated agent. (B) NOTWITHSTANDING ANY OTHER PROVISION OF THE LAW TO THE CONTRARY, A RECIPIENT OF TEMPORARY HOUSING ASSISTANCE SHALL NOT BE REQUIRED TO MAKE A FINANCIAL CONTRIBUTION TOWARD THE COST OF TEMPORARY HOUSING ASSIST- ANCE. A SOCIAL SERVICES DISTRICT MAY TERMINATE TEMPORARY HOUSING ASSIST- ANCE TO A RECIPIENT ONLY IF THE RECIPIENT ENGAGES IN ACTS WHICH POSE AN IMMINENT THREAT TO THE HEALTH OR SAFETY OF THE RECIPIENT OR OTHERS. WHEN A RECIPIENT COMMITS SUCH ACTS, INCLUDING BUT NOT LIMITED TO ACTS OF VIOLENCE OR SELLING DRUGS, THE SOCIAL SERVICES DISTRICT MAY DISCONTINUE TEMPORARY HOUSING ASSISTANCE UNTIL SUCH ACTS CEASE OR FOR SEVEN DAYS, WHICHEVER PERIOD IS SHORTER. SUCH SOCIAL SERVICES DISTRICT, IN LIEU OF APPLYING THAT PORTION OF A TEMPORARY HOUSING ASSISTANCE RECIPIENT'S EARNED INCOME THAT, BUT FOR THE OTHER PROVISIONS OF THIS CHAPTER, WOULD BE APPLIED TO REDUCE THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
