BILL NUMBER:A8769 TITLE OF BILL: An act to amend the public authorities law, in relation to authorizing the town of North Hempstead to create a townwide environmental improvement district PURPOSE OR GENERAL IDEA OF BILL: To authorize the Town of North Hempstead to create a townwide environmental district to identify and fund the costs associated with landfill maintenance. SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill amends 2049-e of the public authorities law by adding a new subdivision 4 which authorizes the Town of North Hempstead to establish a townwide environmental improvement district. JUSTIFICATION: In order to assist in identifying costs and allocating resources for landfill maintenance, the Town of North Hempstead is asking for the authority to create a townwide environmental district. This district would improve transparency in the town government by creating a new budget line for the costs and appropriations associated with landfill maintenance. Currently, the costs of landfill maintenance are a part of the general fund. PRIOR LEGISLATIVE HISTORY: New Bill FISCAL IMPLICATIONS: None to the state

Section 2049-e of the public authorities law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING THE PROVISIONS OF ANY OTHER LAW, GENERAL, SPECIAL OR LOCAL, THE TOWN BY RESOLUTION OF THE TOWN BOARD AFTER AT LEAST THIRTY DAYS PUBLIC NOTICE AND A PUBLIC HEARING, IS HEREBY AUTHORIZED TO ESTAB- LISH A TOWNWIDE ENVIRONMENTAL IMPROVEMENT DISTRICT, ENCOMPASSING ALL REAL PROPERTY WITHIN SUCH TOWN, FOR THE PURPOSES OF ASSISTING THE AUTHORITY IN FULFILLING ITS POWERS AS DESCRIBED IN SECTION TWO THOUSAND FORTY-NINE-D OF THIS TITLE, AND WITH MEETING ANY OBLIGATIONS INCURRED IN THE TREATMENT, MANAGEMENT OR DISPOSAL OF THE TOWN POPULATION'S SOLID WASTE AND ITS BY-PRODUCTS. THE TOWN BOARD SHALL SERVE AS THE BOARD OF COMMISSIONERS OF SUCH DISTRICT. S 2. This act shall take effect immediately.
