BILL NUMBER:A8906 TITLE OF BILL: An act to amend the public health law, the state finance law and the insurance law, in relation to the development of comprehensive care centers for autism spectrum disorders PURPOSE: This legislation would provide for the establishment of Comprehensive Autism Assessment Centers that are designed to ensure that children with Autism Spectrum Disorders will receive a comprehensive assessment that will lead to the development of more effective interventions. SUMMARY OF PROVISIONS: This bill amends the Public Health Law by adding a new Article 27-M to establish Comprehensive Autism Assessment Centers. Section 1 of the bill authorizes the Commissioner of the Department of Health to facilitate the development and establishment of these Centers. The bill sets forth the programmatic components that these Centers shall contain including: *Intensive Assessment Services including integrated, interdisciplinary analysis of a child's functional characteristics and disabilities; *Residential services that will provide short-term residential services for children who require a short stay for the period in which

THE LEGISLATURE FINDS THAT AUTISM SPECTRUM DISORDERS (ASD) ARE LIFELONG, NEURODEVELOPMENTAL DISABILITIES THAT INCLUDE AUTISM, PERVASIVE DEVELOPMENTAL DISORDER - NOT OTHERWISE SPECIFIED (PDD-NOS), AND ASPERGER SYNDROME. EACH OF THESE CONDITIONS SHARES SOME OF THE SAME CHARACTERISTICS; HOWEVER, THEY DIFFER IN ONSET OF SYMPTOMS, SEVERITY OF SYMPTOMS, AND THE NATURE OF THE SYMPTOMS. THESE CONDITIONS ALONG WITH CHILDHOOD DISINTEGRATIVE DISORDER (CDD) AND RETT SYNDROME CONSTITUTE THE BROADER CATEGORY OF PERVASIVE DEVELOPMENTAL DISORDER. THERE IS NO MEDICAL TEST TO DIAGNOSE ASD, INSTEAD A DIFFEREN- TIAL DIAGNOSIS IS MADE ON THE BASIS OF OBSERVATION AND ASSESSMENT OF THE CHILD AS WELL AS AN INTERVIEW PROCESS WITH THE CAREGIVER OR CAREGIVERS. THE LEGISLATURE FURTHER FINDS THAT ASDS OCCUR IN ALL RACIAL, ETHNIC, AND SOCIOECONOMIC GROUPS AND ARE FOUR TIMES MORE LIKELY TO OCCUR IN EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. The public health law is amended by adding a new section 2822 to read as follows: S 2822. AUTISM ASSESSMENT CENTERS. 1. THE LEGISLATURE FINDS THAT THE DRAMATIC INCREASE IN THE PREVALENCE OF INDIVIDUALS IDENTIFIED WITH AUTISM SPECTRUM DISORDERS (ASP) AND OTHER COMPLEX DEVELOPMENTAL DISABIL- ITIES REPRESENTS A SIGNIFICANT CHALLENGE IN ENSURING THE PROPER ASSESS- MENT AND DEVELOPMENT OF APPROPRIATE INDIVIDUALIZED INTERVENTIONS FOR CHILDREN WITH SEVERE MANIFESTATIONS OF ASD. THE SEVERE, PERVASIVE NATURE OF THESE DISABILITIES IS MANIFESTED NOT ONLY IN DEVELOPMENTAL AND BEHAVIORAL PROBLEMS, BUT IN THE MORE SEVERE CASES, PHYSICAL SYMPTOMS AS WELL. PRESENTING CHARACTERISTICS OF INDIVIDUALS WITH AUTISM SPECTRUM DISORDERS AND COMPLEX DISABILITIES INCLUDE SOCIAL AND COGNITIVE IMPAIR- MENT; LANGUAGE DISTURBANCES; PROBLEMS WITH ATTENTION AND SELF-REGULA- TION; REPETITIVE, STEREOTYPED, AGGRESSIVE, SELF-INJURIOUS BEHAVIORS; AND, OFTEN COMPLEX AND SEVERE CASES CO-OCCURRING WITH MEDICAL CONDITIONS SUCH AS SEIZURE AND SLEEP DISORDERS; AND, PSYCHIATRIC AND HEALTH CONDI- TIONS SUCH AS FRAGILE X SYNDROME AND TUBEROUS SCLEROSIS. FOR THESE REASONS, THE LEGISLATURE DECLARES THAT THE ESTABLISHMENT OF NEW SHORT-TERM BEHAVIORAL AND ASSESSMENT INTERVENTION UNITS TO PROVIDE FOR THE ASSESSMENT AND INTERVENTION FOR CHILDREN WITH SEVERE FORMS OF ASD IS NECESSARY.
