BILL NUMBER:A8953 TITLE OF BILL: An act to amend the public authorities law, in relation to issuance of annual special hauling permits for trucking companies in certain circumstances on the New York state thruway in the Westchester area PURPOSE: This bill provides for issuance of annual special hauling permits for trucking companies in certain circumstances on the New York State thruway in the Westchester area JUSTIFICATION: This bill would make it easier for Samuel Blakley Tree Company to move bucket trucks within his local operating area. Bucket trucks need a daily over length permit for the NYS Thruway System. These units operate for two local utility companies on a daily basis in and around Westchester /Rockland County. They can be called in to service at anytime for emergency response to the MTA, Consolidated Edison, Orange and Rockland for daily contracted jobs. In the past this company has been called in by the NYSTA for rock slides and bridge collapse on emergency. Similar annual permits are available to the NYS Steel Haulers and the Milk Haulers. PRETLOW -- read once and referred to the Commit- tee on Transportation AN ACT to amend the public authorities law, in relation to issuance of annual special hauling permits for trucking companies in certain circumstances on the New York state thruway in the Westchester area THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 381-a to read as follows: S 381-A. FURTHER ADDITIONAL POWERS OF THE AUTHORITY TO ISSUE SPECIAL HAULING PERMITS IN THE WESTCHESTER AREA. 1. THE AUTHORITY IS HEREBY AUTHORIZED AND DIRECTED TO ISSUE ANNUAL SPECIAL HAULING PERMITS TO TRUCKING COMPANIES FOR TRAVEL WITHIN THE WESTCHESTER AREA WHEN SUCH TRUCKING COMPANIES ARE OPERATING IN RESPONSE TO CERTAIN SPECIAL CIRCUM- STANCES, INCLUDING BUT NOT LIMITED TO: (A) AN EMERGENCY SITUATION CALLED IN BY THE METROPOLITAN TRANSPORTA- TION AUTHORITY; (B) AN EMERGENCY SITUATION, INCLUDING BUT NOT LIMITED TO, ROCK SLIDES AND BRIDGE OR STRUCTURAL COLLAPSES CALLED IN BY THE AUTHORITY; (C) AN EMERGENCY SITUATION, INCLUDING BUT NOT LIMITED TO FACILITY AND STRUCTURE MAINTENANCE CALLED IN BY CONSOLIDATED EDISON OR ANY OTHER LOCAL UTILITY COMPANY. 2. SUCH PERMIT SHALL BE VALID FOR ONE YEAR AND MAY BE RENEWED ANNUAL- LY. 3. THE PROCESSING FEE FOR SUCH PERMIT SHALL BE THREE HUNDRED DOLLARS. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law; provided, however, that the thruway authori- ty shall promulgate any rules and regulations necessary for the imple- mentation of this act on or before such effective date.
