BILL NUMBER:A9203 TITLE OF BILL: An act to amend the highway law, in relation to drug free zone signs near public libraries PURPOSE: Allows any political subdivision of the state having jurisdic- tion over any road fronting any public library as defined by the educa- tion law, may, at the request of the library, place signs indicating a drug free zone within the right of way of the highway. SUMMARY OF PROVISIONS: Section 1 adds a new Section 318 to the Highway Law for Drug Free Library Zone signs. Section 2 effective date EXISTING LAW: Current law provides for Drug Free Zone signage within right of way of the highways fronting public schools. No current law for Drug Free Library Zones. JUSTIFICATION: Our public libraries, like our schools, service children and young adults. Ensuring Drug Free Zones around Libraries is another step toward protecting these children when they are frequenting the Library. LEGISLATIVE HISTORY: New bill.

GUNTHER -- read once and referred to the Commit- tee on Transportation AN ACT to amend the highway law, in relation to drug free zone signs near public libraries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The highway law is amended by adding a new section 318 to read as follows: S 318. DRUG FREE LIBRARY ZONE SIGNS. ANY POLITICAL SUBDIVISION OF THE STATE HAVING JURISDICTION OVER ANY HIGHWAY FRONTING ANY PUBLIC LIBRARY, AS DEFINED IN SUBDIVISION TWO OF SECTION TWO HUNDRED FIFTY-THREE OF THE EDUCATION LAW, MAY, UPON THE REQUEST OF THE APPROPRIATE LIBRARY AUTHORI- TY, PLACE, CAUSE TO BE PLACED, OR PERMIT TO BE PLACED WITHIN THE RIGHT OF WAY OF SUCH HIGHWAY, SIGNS INDICATING A DRUG FREE ZONE. BILL NUMBER:A9203A TITLE OF BILL: An act to amend the penal law, in relation to criminal sale of a controlled substance upon the grounds of a library PURPOSE: creates a drug-free zone in and around (within 1000 feet) of a public library or association library. SUMMARY OF PROVISIONS: Section 1 adds a new Section 220-61 to the penal law that a person is guilty of criminal sale of a controlled substance upon the grounds of a library when he or she sells a controlled substance, Section 2 on the grounds of a public library or association library shall mean in, on or within any building, parking lot or land and any area accessible to the public within one thousand feet of the real prop- erty line comprising the library. EXISTING LAW: Current law provides for Drug Free Zones in, on or within any public schools or within 1000 feet. No current law for Drug Free Library Zones. JUSTIFICATION: Our libraries, like our schools, service children and young adults. Ensuring Drug Free Zones around Libraries is another step toward protecting these children when they are frequenting the Library.

The penal law is amended by adding a new section 220.61 to read as follows: S 220.61 CRIMINAL SALE OF A CONTROLLED SUBSTANCE UPON THE GROUNDS OF A LIBRARY. 1. A PERSON IS GUILTY OF CRIMINAL SALE OF A CONTROLLED SUBSTANCE UPON THE GROUNDS OF A LIBRARY WHEN HE OR SHE KNOWINGLY AND UNLAWFULLY SELLS A CONTROLLED SUBSTANCE IN VIOLATION OF: (A) ANY ONE OF SUBDIVISIONS ONE THROUGH SIX-A OF SECTION 220.34 OF THIS ARTICLE, WHEN SUCH SALE TAKES PLACE UPON THE GROUNDS OF A PUBLIC LIBRARY OR ASSOCIATION LIBRARY AS THOSE TERMS ARE DEFINED IN SUBDIVISION TWO OF SECTION TWO HUNDRED FIFTY-THREE OF THE EDUCATION LAW; OR (B) ANY OF THE SUBDIVISIONS ONE THROUGH EIGHT OF SECTION 220.39 OF THIS ARTICLE, WHEN SUCH SALE TAKES PLACE UPON THE GROUNDS OF A PUBLIC LIBRARY OR ASSOCIATION LIBRARY AS THOSE TERMS ARE DEFINED IN SUBDIVISION TWO OF SECTION TWO HUNDRED FIFTY-THREE OF THE EDUCATION LAW. 2.
