AN  ACT  to  amend  the  environmental  conservation law, in relation to
  establishing a registry program for  saltwater  recreational  anglers;
  and  to  repeal  section 13-0355 of the environmental conservation law
  relating thereto

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  13-0355 of the environmental conservation law is
REPEALED and a new section 13-0355 is added to read as follows:
S 13-0355. REGISTRY PROGRAM FOR SALTWATER RECREATIONAL ANGLERS.
  1. THE COMMISSIONER SHALL ESTABLISH, IMPLEMENT AND MAINTAIN A REGISTRY
PROGRAM FOR SALTWATER RECREATIONAL ANGLERS WHICH SHALL PROVIDE FOR:
  A. THE REGISTRATION, INCLUDING BUT NOT LIMITED TO, IDENTIFICATION  AND
CONTACT INFORMATION OF INDIVIDUALS WHO ENGAGE IN RECREATIONAL FISHING IN
THE NEW YORK STATE MARINE AND COASTAL DISTRICT; AND
  B. THE REGISTRATION, INCLUDING BUT NOT LIMITED TO, THE OWNER, OPERATOR
AND IDENTIFICATION OF THE VESSEL IF SUCH VESSEL IS USED IN FISHING.
  2.  A. THE REGISTRY PROGRAM ESTABLISHED PURSUANT TO THIS SECTION SHALL
COMPLY WITH THE PROVISIONS OF THE REGISTRY PROGRAM ESTABLISHED  PURSUANT
TO  THE "MAGNUSON-STEVENS FISHERY CONSERVATION AND MANAGEMENT REAUTHORI-
ZATION ACT OF 2006" (16 U.S.C. S 1801 ET SEQ.).
  B. UPON  ESTABLISHMENT  OF  THE  REGISTRY  PROGRAM  PURSUANT  TO  THIS
SECTION,  THE  COMMISSIONER SHALL APPLY TO THE NATIONAL MARINE FISHERIES
SERVICE OF THE NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION  FOR  THE
EXEMPTED STATE DESIGNATION FROM FEDERAL REGISTRATION REQUIREMENTS.
  3. THE DEPARTMENT SHALL NOT CHARGE A FEE FOR THE REGISTRATION REQUIRED
PURSUANT TO THIS SECTION.
  S 2. This act shall take effect immediately.
