BILL NUMBER:A9537 TITLE OF BILL: An act to amend the public health law, in relation to extending the patient bill of rights to faculty practices and in-patient clinics associated with hospitals PURPOSE OR GENERAL IDEA OF BILL: To make the Patients' Bill of Rights applicable to faculty practices. SUMMARY OF SPECIFIC PROVISIONS: Section I. The public health law is amended by adding a new section 22. Section 22. Patients rights; in-pa- tient clinics and faculty practices. The commissioner shall require that every in-patient clinic and faculty practice associated with a hospital adopt and make public an identical statement of the rights and responsi- bilities of patients required to be made by hospitals pursuant to para- graph (g) of subdivision on of section twenty-eight hundred three of this chapter. JUSTIFICATION: In recent years, there have been allegations against New York's academic medical centers for their practice of steering Medicaid and uninsured patients to faculty practices, where they do not receive access to the same quality of care as privately-insured patients. The faculty practices are often located within, or next to Article 28 gener- al hospitals but are not obligated by any of the requirements of the Patients' Bill of Rights because they are classified as independent physicians' group practices. The public health law is amended by adding a new section 22 to read as follows: S 22. PATIENT RIGHTS; IN-PATIENT CLINICS AND FACULTY PRACTICES. THE COMMISSIONER SHALL REQUIRE THAT EVERY IN-PATIENT CLINIC AND FACULTY PRACTICE ASSOCIATED WITH A HOSPITAL ADOPT AND MAKE PUBLIC AN IDENTICAL STATEMENT OF THE RIGHTS AND RESPONSIBILITIES OF PATIENTS REQUIRED TO BE MADE BY HOSPITALS PURSUANT TO PARAGRAPH (G) OF SUBDIVISION ONE OF SECTION TWENTY-EIGHT HUNDRED THREE OF THIS CHAPTER.
