Requires the state to deny the application for a driver's license or permit of any person convicted of any violation resulting from the operation of a motor vehicle in another state where such violation, if committed within the state, would have resulted in a suspension or revocation of such person's New York state driving privileges.

BILL NUMBER: S155 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to the denial of applications for licenses and learner's permits PURPOSE/SUMMARY OF PROVISIONS : This bill would require any new applicant for a driver's license or learner's permit in New York State to disclose under oath whether such applicant has been convicted of a violation which would result, had it occurred within New York State, of a revocation or suspension of driving privileges. The bill would preclude the applicant from receiving a permit or license until penalties are assessed. EXISTING LAW : Amends section 507 of the vehicle and traffic law by adding a new subdivision 6. Seeks to create a more uniform system of penalties for driving offenders. Many states within the current compact do not have driving conditions or penalties as stringent as those of New York State. KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the denial of applications for licenses and learner's permits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 507 of the vehicle and traffic law is amended by adding a new subdivision 6 to read as follows: 6. DENIAL OF APPLICATIONS FOR LICENSES OR LEARNER'S PERMITS. THE COMMISSIONER SHALL REQUIRE THAT EACH APPLICANT FOR A LICENSE OR LEARNER'S PERMIT DISCLOSE UNDER OATH WHETHER SUCH APPLICANT HAS BEEN CONVICTED OF ANY VIOLATION RESULTING FROM THE OPERATION OF A MOTOR VEHI- CLE IN ANOTHER STATE WHERE SUCH VIOLATION, IF COMMITTED WITHIN THE STATE, WOULD HAVE RESULTED IN A SUSPENSION OR REVOCATION OF NEW YORK STATE DRIVING PRIVILEGES. IN THE EVENT SUCH APPLICANT HAS SUCH PRIOR CONVICTION, THE COMMISSIONER SHALL DENY THE APPLICATION FOR LICENSING OR THE LEARNER'S PERMIT OR REVOKE SUCH LICENSE OR LEARNER'S PERMIT UNTIL SUCH APPLICANT HAS SATISFIED THE APPLICABLE PROVISIONS OF NEW YORK STATE STATUTES AND REGULATIONS RELATING THERETO.
