BILL NUMBER: S2572 TITLE OF BILL : An act to amend the general business law and the public service law, in relation to prohibiting providers of service from reviewing or using consumer credit reports for the purpose of determining whether to provide consumers with service PURPOSE : Prohibits service providers from reviewing or using consumer credit reports for the purpose of determining whether to provide or continue to provide service. SUMMARY OF PROVISIONS : No person or entity engaged in the business of providing any service in this state shall review or in any way utilize the consumer credit report, as defined in subdivision (1) of section three hundred eighty-a of this chapter, of any potential customer or customer when making any determination to provide or continue the provision of service to such potential customer or customer. JUSTIFICATION : This bill will protect consumers from organizations who are using the credit report in order to justify their actions in providing services at a higher rate.

BILL NUMBER: S2572B TITLE OF BILL : An act to amend the general business law and the public service law, in relation to prohibiting providers of service from solely relying upon consumer credit reports for the purpose of determining whether to provide consumers with service, or for the purpose of requiring the payment of a deposit, fee or higher rate PURPOSE OR GENERAL IDEA OF BILL : This bill would expand the qualifications for membership into credit unions. SUMMARY OF SPECIFIC PROVISIONS : Section 1. Amends subdivision 2 of section 451 of the banking law to eliminate all of the existing qualifications for membership in a credit union, and provides that the qualifications for memberships shall be determined by the board of directors of the credit union, and hall include persons who were duly admitted members. Section 2: Amends subparagraph (i) of paragraph (c) of subdivision 6 or section 454 of the banking law to place limitations on individual business loans made to its members. Section 3: Amends subparagraph (i) of paragraph (a) of subdivision 18

NOTHING HEREIN SHALL PROHIBIT A SERVICE PROVIDER FROM REVIEWING OR UTILIZING A CONSUMER CREDIT REPORT IN DETERMINING WHETHER AN APPLICANT MUST PROVIDE SURETY PRIOR TO PROVIDING SERVICES. 3.
