BILL NUMBER: S2582 TITLE OF BILL : An act to amend the penal law, in relation to the sale of component parts of a pistol or firearm PURPOSE : Will make it illegal to sell gun parts to any individual that does not possess a valid pistol permit. The part sold must be the same related to the pistol/firearm listed on the purchaser's pistol permit. SUMMARY OF PROVISIONS : Section 1. The penal law is amended by adding a new section 265.45 to read as follows: Sec.265.45 Sale of component parts of a pistol or firearm. 1. Any merchant, manufacturer, firm, corporation, association or agent or employee thereof who offers for sale in this state any component part of a pistol or firearm to any individual who does not possess a valid pistol permit shall be guilty of a class D felony. The component part being purchased must be a component part to the pistol or firearm listed on the purchaser1s valid pistol permit. 2. For purposes of this section "firearm" or "pistol It means a weapon as defined in section 265.00 of this article. JUSTIFICATION :

JOHNSON, KRUEGER, MONSERRATE, MONTGOMERY, ONORATO, PARKER, PERKINS, SCHNEIDERMAN, SERRANO, STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the sale of component parts of a pistol or firearm THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 265.45 to read as follows: S 265.45 SALE OF COMPONENT PARTS OF A PISTOL OR FIREARM. 1. ANY MERCHANT, MANUFACTURER, FIRM, CORPORATION, ASSOCIATION OR AGENT OR EMPLOYEE THEREOF WHO OFFERS FOR SALE IN THIS STATE ANY COMPONENT PART OF A PISTOL OR FIREARM TO ANY INDIVIDUAL WHO DOES NOT POSSESS A VALID PISTOL PERMIT SHALL BE GUILTY OF A CLASS D FELONY. THE COMPONENT PART BEING PURCHASED MUST BE A COMPONENT PART TO THE PISTOL OR FIREARM LISTED ON THE PURCHASER'S VALID PISTOL PERMIT. 2. FOR PURPOSES OF THIS SECTION "FIREARM" OR "PISTOL" MEANS A WEAPON AS DEFINED IN SECTION 265.00 OF THIS ARTICLE. S 2. This act shall take effect on the ninetieth day after it shall have become a law.
