BILL NUMBER: S3479 TITLE OF BILL : An act authorizing the Hamburg central school district to receive certain apportionments on an accelerated basis PURPOSE OR GENERAL IDEA OF BILL : To ensure fiscal stability of the school district and to allow the district to continue to provide essential services to school children within the district and other community members. SUMMARY OF SPECIFIC PROVISIONS : Section 1 provides for a lottery advance of $3.1 million in aid to the Hamburg central School District in the 2008-09 school year. This assistance would be in the form of accelerated payment of funds that would ordinarily have been disbursed in 2009-10. Section 2 provides that this act shall take effect immediately. JUSTIFICATION : The bill would provide for $3.1 million in aid to the Hamburg Central

STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- commit- tee discharged, bill amended, ordered reprinted as amended and recom- mitted to said committee -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT authorizing the Hamburg central school district to receive certain apportionments on an accelerated basis THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. In order to avoid endangering the fiscal stability of Hamburg central school district, certain apportionments payable to the Hamburg central school district of Erie county to be paid on an acceler- ated schedule as follows: a. (1) Notwithstanding any other provisions of law, for aid payable in the school years 2009-2010 through 2037-2038 upon application to the commissioner of education submitted not sooner than the second Monday in June of the school year in which such aid is payable and not later than the Friday following the third Monday in June of the school year in which such aid is payable, or ten days after the effective date of this act, whichever shall be later, the Hamburg central school district shall be eligible to receive an apportionment pursuant to this act in an amount equal to the product of 3,100,000 and the quotient of the posi- tive difference of thirty minus the number of school years elapsed since the 2009-2010 school year divided by thirty. (2) Funds apportioned pursuant to this subdivision shall be used for services and expenses of the Hamburg central school district of Erie county and shall be applied to support of its educational programs and any liability incurred by such city school district in carrying out its functions and responsibilities under the education law. b. The claim for an apportionment to be paid to the Hamburg central school district pursuant to subdivision a of this section shall be EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
