BILL NUMBER: S3845 TITLE OF BILL : An act to amend the public health law, in relation to office-based surgery PURPOSE : This bill makes a technical correction to Chapter 365 of the Laws of 2007 regarding the oversight of office-based surgery. SUMMARY OF PROVISIONS : Section one amends paragraph (i) of subdivision 1 of section 230-d of the public Health Law by adding language to the definition of, "Licensee" stipulating that it does not include an individual licensed under both Articles 131 and 133 of the Education Law who is practicing in a professional service corporation, or any other entity authorized only to engage in the practice of dentistry. EXISTING LAW : None. JUSTIFICATION : Chapter 365 of the Laws of 2007 enacted provisions, recommended by the Department of Health, regarding the oversight of office-based surgery. DUANE -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to office-based surgery THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (i) of subdivision 1 of section 230-d of the public health law, as added by chapter 365 of the laws of 2007, is amended to read as follows: (i) "Licensee" shall mean an individual licensed or otherwise author- ized under articles one hundred thirty-one or one hundred thirty-one-B of the education law EXCEPT IT SHALL NOT INCLUDE AN INDIVIDUAL LICENSED UNDER BOTH ARTICLES ONE HUNDRED THIRTY-ONE AND ONE HUNDRED THIRTY-THREE OF THE EDUCATION LAW WHO IS PRACTICING DENTISTRY IN A PROFESSIONAL SERVICE CORPORATION OR IN ANY OTHER ENTITY AUTHORIZED ONLY TO ENGAGE IN THE PRACTICE OF DENTISTRY. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00771-02-9
