BILL NUMBER: S4195 TITLE OF BILL : An act to amend the criminal procedure law, in relation to security services in the courts PURPOSE : This legislation would amend the Criminal Procedure Law to provide that where the Monroe County Sheriff designates persons in his or her office to provide court security only and to perform no other function or duty, persons so designated would be peace officers. SUMMARY OF PROVISIONS : Section one of this measure amends subdivision one of section 2.10 of the Criminal Procedure Law, adding a new paragraph g. JUSTIFICATION : This measure has been introduced at the request of the Monroe County Executive. The New York State Office of Court Administration (OCA) contracts and pays for court security personnel in the Hall of Justice in the City of Rochester. The OCA requires that all such personnel be certified and registered with the Bureau of Municipal Police. OCA has recommended Monroe County seek this special legislation for classifying Monroe County deputy sheriff court security deputies who are appointed by the Sheriff of Monroe County as peace officers.

NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to security services in the courts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 21 of section 2.10 of the criminal procedure law is amended by adding a new paragraph g to read as follows: G. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (B) OF SUBDIVISION THIRTY-FOUR OF SECTION 1.20 OF THIS CHAPTER, A DEPUTY SHERIFF CURRENTLY OR IN THE FUTURE EMPLOYED BY THE SHERIFF'S DEPARTMENT OF MONROE COUNTY WHO IS DESIGNATED BY THE SHERIFF TO PERFORM THE DELIVERY OF SECURITY SERVICES TO THE COURTS. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A DEPUTY SHERIFF CURRENTLY OR IN THE FUTURE EMPLOYED BY THE SHERIFF'S DEPARTMENT OF MONROE COUNTY WHO IS DESIGNATED BY THE SHERIFF TO PERFORM THE DELIVERY OF SECURITY SERVICES TO THE COURTS SHALL BE ELIGIBLE TO PARTICIPATE IN THE TWENTY-FIVE YEAR RETIREMENT PLAN SET FORTH IN SECTION EIGHTY-NINE-N OR EIGHTY-NINE-P OF THE RETIREMENT AND SOCIAL SECURITY LAW, AS THE CASE MAY BE, AND SHALL BE ELIGIBLE TO RECEIVE THE PAYMENT OF SALARY, WAGES, MEDICAL AND HOSPITAL EXPENSES INCURRED IN THE PERFORMANCE OF SUCH DEPUTY SHERIFF'S DUTIES AS SET FORTH IN SECTION TWO HUNDRED SEVEN-C OF THE GENERAL MUNICIPAL LAW. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
