 TITLE OF BILL :
An act to amend the public service law, in relation to farm waste net
energy metering


 PURPOSE OR GENERAL IDEA OF BILL :
This legislation amends section 66-j of Public Service law to ensure
more equitable net metering provisions for owners of farm-based
anaerobic or manure digesters in New York State.

 SUMMARY OF SPECIFIC PROVISIONS :
Section 66-j of the Public Service law is amended to:

* Amends subsection 1-e the definition of "farm waste electric
generating equipment" to increase the allowable rated capacity to not
more than one thousand kilowatts.

* Adds a new subsection 2-a to allow owners of anaerobic digester to
own any environment attributes and provide such owners the ability to
grant ownership of these attributes to other entities.

* Amends subsection 4-c, (ii) to reduce the rate paid by owners or
operators of anaerobic digesters for grid connection from $5,000 to
$3,000 per farm operation.

* Adds a new subsection 5-e to allow eligible credits sustained from
net metering activity from farm anaerobic digesters be applied against
electricity use from all grid connections on the farm operation.

 JUSTIFICATION :
This legislation would make needed amendments to net metering laws as
adopted by New York State during the 2008 Legislative Session for
anaerobic digesters.  These digesters are mostly located on dairy
farms where methane from manure is captured and used to produce
electricity on the farm and, in many cases, net metered back to the
grid for use by others.

The 2008 net-metering law further encourages the development of behind
the meter renewable energy sources. These changes were designed to
further incentivize the development of renewable energy sources that
individual ratepayers would construct.  This helps increase the amount
of renewable energy available in New York and reduce our dependence on
fossil fuels. However, there are a number of issues that need to be
addressed as a result of the passage of this legislation to ensure
that the digester technology is treated equitably, when compared to
solar and wind technologies. This bill seeks to make these changes,
including expansion of the amount of energy that can be net metered
for anaerobic digesters. By addressing these issues, this legislation
improves the state's positive net-metering law for this farm-specific
renewable energy technology and provides both benefits for the
environment and renewable energy production.

 EFFECTIVE DATE :
This act shall take effect on the thirtieth day after it shall have

AN  ACT  to  amend the public service law, in relation to farm waste net
  energy metering

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The opening paragraph of paragraph (e) of subdivision 1 of
section 66-j of the public service law, as amended by chapter 480 of the
laws of 2008, is amended to read as follows:
  "Farm waste electric generating equipment" means equipment that gener-
ates electric energy from biogas produced by the anaerobic digestion  of
agricultural  waste,  such  as livestock manure, farming wastes and food
processing wastes with a rated capacity of not more than [five  hundred]
ONE THOUSAND kilowatts, that is:
  S 2. Section 66-j of the public service law is amended by adding a new
subdivision 2-a to read as follows:
  2-A.  ENVIRONMENTAL ATTRIBUTES. NOTWITHSTANDING ANY OTHER PROVISION OF
LAW, A  CUSTOMER-GENERATOR  OPERATING  FARM  WASTE  ELECTRIC  GENERATION
EQUIPMENT SHALL HAVE ALL OWNERSHIP OF ANY ENVIRONMENTAL ATTRIBUTES ASSO-
CIATED  WITH SUCH FARM WASTE ELECTRICAL GENERATION EQUIPMENT UNLESS SUCH
ATTRIBUTES ARE SPECIFICALLY GRANTED BY  THE  CUSTOMER-GENERATOR  TO  ANY
OTHER PARTY.
  S  3.  Subparagraph  (ii) of paragraph (c) of subdivision 3 of section
66-j of the public service law, as amended by chapter 452 of the laws of
2008, is amended to read as follows:
  (ii) In the case of a customer-generator who  owns  or  operates  farm
waste electric generating equipment located and used at his or her "farm
operation,"  up  to  a total amount of [five] THREE thousand dollars per
"farm operation".

  S 4. Subdivision 4 of section  66-j  of  the  public  service  law  is
amended by adding a new paragraph (e) to read as follows:
  (E) FOR PURPOSES OF PARAGRAPH (B) OF THIS SUBDIVISION, ELECTRICITY USE
ELIGIBLE  FOR  CREDIT OFFSETS SHALL INCLUDE ALL ELECTRICITY USE FROM ALL
GRID CONNECTIONS ASSOCIATED WITH A FARM OPERATION.
  S 5. This act shall take effect on the thirtieth day  after  it  shall
have become a law.
