 TITLE OF BILL :
An act to amend the agriculture and markets law, in relation to
establishing a wood products development council


 PURPOSE OR GENERAL IDEA OF BILL :
This bill would create a Wood Products Development Council within the
New York State Department of Agriculture and Markets.

 SUMMARY OF SPECIFIC PROVISIONS :
Section 1 amends section 16 of the agriculture and markets law to
expand the powers and duties of the Department to include encouraging
and supporting the practice of forestry and the manufacture of wood
products.

Section 2 of the bill adds a new article 18 to the agriculture and
markets law creating the Wood Products Council, providing for its
membership and directing it to, among other things, work with
wood-using manufacturers to increase the economic vitality of the wood
products industry.

 JUSTIFICATION :
The Wood Products Development Council will provide economic, social,
and environmental benefits for New York, while improving the

effectiveness of government programs and the quality of life in
upstate communities. Since the late nineteenth century, the size of
New York's forest has increased steadily to the point where over 60%
of the state is now covered by forest, a forest is distinguished by
its variety and quality hardwoods. About 47,000 New Yorkers work in
the forest products industry, earning approximately $2 billion in
high-paying jobs in small rural communities.

In an era of an increasing level of international trade, New York's
hardwood forests can readily provide exports to worldwide markets with
strong demand for our forest products.  Yet even though the growth,
manufacture, and sale of forest products is a key component of the
upstate economy, New York is missing a significant opportunity for
economic growth, because there is no coordination between
stakeholders, to maximize, nurture, and manage this critical resource.
Increasing New York's hardwood forest industry would provide more good
paying jobs and invigorate the economies of rural communities. The
industry is characterized by family and multigenerational ownerships.
It also has strong economic development multipliers, as the production
of forest products requires highly-skilled and knowledge-based support
in engineering and logistics.

Forest products link value-added manufacturing and processing with
environmental good sense because the industry serves as a steward of
our forests. Just like agriculture, proper forestry is a stewardship
practice, yielding clean water and air, removing greenhouse gases, and
preventing or mitigating natural disasters like floods and wildfire.

This bill creates a Wood Products Development Council to work closely
with the state's leading rural economic development agency, the
Department of Agriculture and Markets.  Representing all stakeholders,
from lumber to maple syrup, from forest owners to furniture
manufacturers, the Council would advise the Governor on forest
products policy, raise public awareness of the benefits of a healthy
forest products industry, provide technical assistance to forest
product businesses, help ensure that forest resources are put to
beneficial use, and develop the wider value-added forest product
industry.


Numerous policy initiatives have pointed to the need for this level of
recognition and coordination. The Governor's Task Force on the Forest
Industry and the Northern Forest Lands Council identified the
opportunities. New York's Open Space Place recognizes the important
role that the forest products industry plays in helping to support
family and working forests.

Pennsylvania has had a Hardwoods Development Council since 1988, and
has successfully increased that state's exports of hardwood products
across the country and abroad.

 PRIOR LEGISLATIVE HISTORY :

 FISCAL IMPLICATIONS :
Minimal as it allows for the reimbursement of board members for their
actual and necessary travel expenses.

 EFFECTIVE DATE :
Immediately.

AN ACT to amend the agriculture and markets law, in relation  to  estab-
  lishing a wood products development council

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 16 of the agriculture and markets law is amended by
adding a new subdivision 44 to read as follows:
  44. ENCOURAGE AND SUPPORT THE PRACTICE OF FORESTRY AND MANUFACTURE  OF
WOOD  PRODUCTS  IN  THE  STATE,  IN COORDINATION WITH THE DEPARTMENTS OF
ENVIRONMENTAL CONSERVATION AND ECONOMIC DEVELOPMENT; AND PROVIDE FOR THE
OPERATION OF THE WOOD PRODUCTS DEVELOPMENT  COUNCIL  AS  ESTABLISHED  IN
SECTION TWO HUNDRED TWENTY-FIVE OF THIS CHAPTER.
  S  2. The agriculture and markets law is amended by adding a new arti-
cle 18 to read as follows:
                               ARTICLE 18
                        WOOD PRODUCTS DEVELOPMENT
SECTION 225. WOOD PRODUCTS DEVELOPMENT COUNCIL.
  S 225. WOOD PRODUCTS DEVELOPMENT COUNCIL. 1. THERE  IS  HEREBY  ESTAB-
LISHED  WITHIN  THE DEPARTMENT A WOOD PRODUCTS DEVELOPMENT COUNCIL. SUCH
COUNCIL SHALL CONSIST OF THE COMMISSIONER, THE COMMISSIONERS OF ENVIRON-
MENTAL CONSERVATION AND ECONOMIC DEVELOPMENT, OR  THEIR  DESIGNEES,  AND
TEN  OTHER PERSONS TO BE APPOINTED BY THE GOVERNOR, INCLUDING ONE MEMBER
ON THE RECOMMENDATION OF THE TEMPORARY  PRESIDENT  OF  THE  SENATE;  ONE
MEMBER  ON THE RECOMMENDATION OF THE SPEAKER OF THE ASSEMBLY; ONE MEMBER
ON THE RECOMMENDATION OF THE MINORITY LEADER  OF  THE  SENATE;  AND  ONE
MEMBER  ON THE RECOMMENDATION OF THE MINORITY LEADER OF THE ASSEMBLY. OF
THE MEMBERS SO APPOINTED, AT LEAST ONE MEMBER SHALL BE A SAWMILL  OWNER,
ONE  MEMBER  SHALL BE A SECONDARY WOOD PRODUCTS MANUFACTURER, ONE MEMBER

WIDE  FOREST  INDUSTRY ORGANIZATION, AND ONE MEMBER SHALL BE A REPRESEN-
TATIVE OF A STATEWIDE FOREST LANDOWNERS ASSOCIATION.  MEMBERS  SHALL  BE
APPOINTED FOR A TERM OF THREE YEARS AND MAY SERVE UNTIL THEIR SUCCESSORS
ARE  CHOSEN,  PROVIDED,  HOWEVER,  THAT  OF THE MEMBERS FIRST APPOINTED,
THREE SHALL SERVE FOR A TERM OF ONE YEAR, THREE SHALL SERVE FOR  A  TERM
OF TWO YEARS, AND FOUR SHALL SERVE FOR A TERM OF THREE YEARS. THE GOVER-
NOR  SHALL SELECT A MEMBER OF THE COUNCIL TO SERVE AS CHAIRPERSON. COUN-
CIL MEMBERS SHALL NOT RECEIVE COMPENSATION FOR THEIR SERVICES,  BUT  MAY
BE PAID THEIR ACTUAL AND NECESSARY EXPENSES INCURRED IN SERVING UPON THE
COUNCIL.
  2.  THE  COUNCIL  SHALL WORK WITH WOOD-USING MANUFACTURERS TO INCREASE
THE ECONOMIC CONTRIBUTIONS AND EMPLOYMENT OPPORTUNITIES RELATED  TO  THE
PRACTICE OF FORESTRY AND MANUFACTURE OF WOOD PRODUCTS IN NEW YORK STATE.
THE  COUNCIL  SHALL  GIVE  PRIORITY  TO INCREASING PRIVATE INVESTMENT IN
WORKING FORESTS; MAINTAINING ACCESS TO WORKING AND FAMILY FORESTS; COOR-
DINATING POLICY AND PERMITTING ISSUES WITH STATE AGENCIES, ACADEMIA  AND
THE  PRIVATE  SECTOR;  WORKING  TO  IMPROVE  PUBLIC UNDERSTANDING OF AND
APPRECIATION FOR FORESTRY AND FOREST PRODUCTS; AND INCREASING EXPORT AND
MARKET OPPORTUNITIES FOR NEW YORK FOREST PRODUCTS.
  3. THE DEPARTMENT SHALL PROVIDE  NECESSARY  SUPPORT  SERVICES  TO  THE
COUNCIL, INCLUDING, WITHIN FUNDS AVAILABLE, THE APPOINTMENT OF AN EXECU-
TIVE DIRECTOR TO COORDINATE THE WORK OF THE COUNCIL.
