BILL NUMBER: S4467 TITLE OF BILL : An act granting retroactive tier I membership in the New York state teachers' retirement system to Linda Frontera PURPOSE : To allow Linda Frontera, who is employed by the Lancaster Central school system, to be reclassified as a Tier 1 member of the New York State teachers' retirement system. SUMMARY OF PROVISIONS : Section 1 permits Linda Frontera membership under Tier 1 of the NYS Teachers' Retirement System based on her employment which began on June 30, 1969 with the city of Lackawanna. Section 2 states that all the costs associated with the enactment of this legislation shall be assumed by the state of New York. JUSTIFICATION : For reasons not ascribable to her own negligence, Ms. Frontera was not offered membership in the New York State Teachers' Retirement System

STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT granting retroactive tier I membership in the New York state teachers' retirement system to Linda Frontera THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any inconsistent provision of law, Linda Frontera, who was employed by the city of Lackawanna from June 30, 1969 to August 27, 1971 and by the county of Erie from May 30, 1972 to Janu- ary 2, 1974, and who is currently a member of the New York state teach- ers' retirement system with tier II status, who through no fault of her own negligence did not become a member of the New York state and local employees' retirement system in June 1969 when first employed by the city of Lackawanna shall be deemed to have been a member of the New York state teachers' retirement system on such date as she commenced such employment and shall be granted tier I status, provided that an applica- tion is filed with the head of the New York state teachers' retirement system within one year of the effective date of this act. S 2. Any costs incurred as a result of the enactment of this act shall be borne by the employers of members of the New York state teachers' retirement system. S 3. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law Section 50: This bill would allow Linda Frontera, a Tier II member of the New York State Teachers' Retirement System, to be reclassified as a Tier I member. Her date of membership would be changed based upon her employ- ment by the city of Lackawanna in 1969. The cost of this benefit is equal to the increase in the present value of liabilities, which is estimated to be $57,000.
