BILL NUMBER: S451 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to requiring approval of the commissioner of agriculture and markets for the compromise of any fine or penalty relating to kosher violations SUMMARY : This bill amends Section 201-d of the Agriculture and Markets Law to prohibit any penalty, fine, civil or criminal, violation of kosher enforcement laws to be compromised or reduced without the approval of the Commissioner of Agriculture. JUSTIFICATION : Currently, the Attorney General's office has the power to compromise or reduce any penalty or fine imposed on kosher food establishments for violation of kosher enforcement laws, without needing the consent of the Commissioner of Agriculture. This occurs very often and therefore lightens the penalty on the kosher establishments for violating kosher enforcement laws. This bill would make it tougher for this to take place, because of the approval needed by the commissioner for the penalty to be reduced. FISCAL IMPLICATION : None.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to requir- ing approval of the commissioner of agriculture and markets for the compromise of any fine or penalty relating to kosher violations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 201-d of the agriculture and markets law is amended by adding a new closing paragraph to read as follows: NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO CHARGE OR PENALTY, CIVIL OR CRIMINAL, FOR VIOLATION OF ANY OF THE PROVISIONS OF SECTION TWO HUNDRED ONE-A, TWO HUNDRED ONE-B, TWO HUNDRED ONE-C, TWO HUNDRED ONE-E OR TWO HUNDRED ONE-F OF THIS ARTICLE, SHALL BE COMPROMISED OR REDUCED WITHOUT THE APPROVAL OF THE COMMISSIONER OR HIS OR HER DULY AUTHORIZED DESIGNEE. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
