BILL NUMBER: S4590 TITLE OF BILL : An act in relation to granting Dennis P. Morris credit in the New York state and local employees' retirement system PURPOSE OR GENERAL IDEA OF BILL : To allow Dennis P. Morris to become a member of the retirement system as of March 7, 1974 provided he files a written request with the comptroller on or before December 31, 2009. SUMMARY OF SPECIFIC PROVISIONS : Section 1 states that Dennis P. Morris was employed from March 7, 1974 through May 20, 2004. Through no negligence on his part Mr. Morris did not become a member of the retirement system. This legislation will give Mr. Morris an employment date of March 7, 1974. JUSTIFICATION : Through no negligence of his own Dennis Morris failed to become a member of the retirement system when first employed by the department of parks, recreation and historic preservation. This legislation would erase this inequity and allow Mr. Morris to gain an employment date as of March 7, 1974. PRIOR LEGISLATIVE HISTORY :

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT in relation to granting Dennis P. Morris credit in the New York state and local employees' retirement system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, Dennis P. Morris, who has been employed by the department of parks, recreation and historic preservation since March 7, 1974, and who, for reasons not ascribable to his own negligence did not join the state and local employees' retirement system on such date and was not credited for service in such retirement system for the period beginning March 7, 1974 and ending May 20, 2004, shall be deemed to have joined such retirement system on March 7, 1974 and shall be credited with service for the peri- od beginning March 7, 1974 and ending May 20, 2004, if, on or before December 31, 2009, he shall file a written request with the state comp- troller to that effect. S 2. All costs associated with the implementation of this act shall be borne by the state of New York. S 3. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, section 50: This bill will grant full-time service credit to Dennis P. Morris, an employee of the New York State Department of Parks and Recreation, for the period from March, 1974 to May, 1998 when he was a part-time seasonal employee. If this bill is enacted there will be an immediate past service cost of approximately $43,900 which will be borne by the State of New York as a one-time payment, assuming a March 1, 2010 payment fate. This estimate, dated April 24, 2009 and intended for use only during the 2009 Legislative Session, is Fiscal Note No. 2009-221, prepared by the Actuary for the New York State and Local Employees' Retirement System. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

Morris to receive civil service credit for examinations and eligible lists as of March 7, 1974 provided he files a written request with the civil service department on or before December 31, 2009. SUMMARY OF SPECIFIC PROVISIONS : Section 1 states that Dennis P. Morris was employed from March 7, 1974 through May 20,2004, and allows him to receive civil service credit for examinations and eligible lists as of March 7, 1974 provided he files a written request with the civil service department on or before December 31,2009. JUSTIFICATION : Mr. Morris's thirty years of service are not currently reflected in the civil service department. This bill would allow Mr. Morris's seasonal employment count towards credit for purposes of examination, eligible lists, appointments, or promotions.
