BILL NUMBER: S4924 TITLE OF BILL : An act to amend the public buildings law, in relation to establishing the state green school construction act PURPOSE OR GENERAL IDEA OF BILL : To require all new construction and substantial reconstruction projects of public school buildings undertaken by school districts and city school districts to comply with green building principles. SUMMARY OF SPECIFIC PROVISIONS : The bill amends the public buildings to require that construction and substantial renovation of school buildings comply with "green" building standards established by the Office of General Services (OGS). OGS will issue regulations in consultation with the New York State Energy Research and Development Authority (NYSERDA), the Department of Environmental Conservation (DEC) , the Department of Health (DOH), the Dormitory Authority of the State of New York (DASNY), the Department of State (DOS), the Department of Education (SED), the Office of Parks, Recreation and Historic Preservation (OPRHP), and any other agency deemed necessary.

THOMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public buildings law, in relation to establishing the state green school construction act THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative findings and declarations. Green building prac- tices can reduce the production of greenhouse gases, lower energy costs, reduce the use of natural resources, reduce waste, improve indoor air quality, and reduce indoor and outdoor pollution. This act requires that the construction and substantial renovation of school buildings comply with "green" building standards established by the office of general services. Building "green" will have positive impacts on our environ- ment, provide healthier indoor environments, and reduce costs. S 2. The public buildings law is amended by adding a new article 4-D to read as follows: ARTICLE 4-D STATE GREEN SCHOOL CONSTRUCTION ACT SECTION 90. SHORT TITLE. 91. DEFINITIONS. 92. APPLICABILITY. 93. GREEN SCHOOL BUILDING CONSTRUCTION REQUIREMENTS. S 90. SHORT TITLE. THIS ARTICLE SHALL BE KNOWN AND MAY BE CITED AS THE "STATE GREEN SCHOOL CONSTRUCTION ACT". S 91. DEFINITIONS. AS USED IN THIS ARTICLE: 1. "AGENCY" SHALL MEAN A STATE DEPARTMENT, STATE AGENCY, OR STATE SCHOOL DISTRICT OR CITY SCHOOL DISTRICT. 2. "AUTHORITY" SHALL MEAN THE NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BILL NUMBER: S4924A TITLE OF BILL : An act to amend the education law, in relation to establishing the state green school construction act PURPOSE OR GENERAL IDEA OF BILL : To require new construction and substantial reconstruction projects of public school buildings undertaken by school districts and city school districts to comply with green building standards, as established by office of general services (OGS) with the consultation of the department of education (DOE) and the New York State energy research and development authority (NYSERDA). SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill amends §408 of the education law by adding new subsection 3-a, which requires state school districts to comply with the energy conservation practices and standards developed by. DOE and NYSERDA. Furthermore, new subsection 3-a establishes exemptions to the building standards which include: 1) an existing school building that has a historic status and compliance would alter the historic character of such school building; 2) compliance would not be cost effective over the useful life of such renovation; 3) compliance would be inconsistent with or violate federal or state law; 4) such other circumstances as DOE may reasonably determine pursuant to regulations

THOMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to establishing the state green school construction act THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 408 of the education law, as amended by section 2 of part A-1 of section 58 of the laws of 2006, is amended and a new subdivision 3-a is added to read as follows: 3. The commissioner shall approve the plans and specifications, here- tofore or hereafter submitted pursuant to this section, for the erection or purchase of any school building or addition thereto or remodeling thereof on the site or sites selected therefor pursuant to this chapter, if such plans conform to the requirements and provisions of this chapter and the regulations of the commissioner adopted pursuant to this chapter in all other respects; provided, however, that the commissioner of education shall not approve the plans for the erection or purchase of any school building or addition thereto unless the site has been selected with reasonable consideration of the following factors; its place in a comprehensive, long-term school building program; area required for outdoor educational activities; educational adaptability, environment, accessibility; soil conditions; initial and ultimate cost. [In developing such plans and specifications, school districts are encouraged to review the energy conservation and saving best practices available from the department and the New York state energy research and development authority.] 3-A. IN DEVELOPING SUCH PLANS AND SPECIFICATIONS, SCHOOL DISTRICTS SHALL BE REQUIRED TO COMPLY WITH THE ENERGY CONSERVATION AND SAVING BEST PRACTICES AVAILABLE FROM THE DEPARTMENT AND THE NEW YORK STATE ENERGY EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
