BILL NUMBER: S5137 TITLE OF BILL : An act in relation to the calculation of aid apportioned to the Shoreham-Wading River central school district PURPOSE : Relates to the calculation of aid apportioned to the Shoreham-Wading River Central School District. SUMMARY OF PROVISIONS : Section one sets the calculation of building aid apportioned for the Shoreham-Wading River school district for any building project which aid is apportioned to pursuant to subdivision 6 of section 3602 at the greater of the following: the building aid ratio computed for use in the current year, or the building aid ration that would have been used in the 1992-93 school year. JUSTIFICATION : The current law allows schools districts to utilize the highest building aid ratio that has been apportioned to the school from 1981

LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT in relation to the calculation of aid apportioned to the Shore- ham-Wading River central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, for calculation of building aid apportioned to the Shoreham-Wading River central school district for aid payable in the school years 2009-2010 and thereafter for all school building projects approved by the voters of the school district on or after July 1, 2009, in lieu of the building aid ratio selected pursuant to paragraph c of subdivision 6 of section 3602 of the education law, the Shoreham-Wading River central school district shall compute aid under the provisions of this section using the sum of the high-need supplemental building aid ratio, if any, computed pursuant to clause (c) of subparagraph 2 of paragraph c of subdivision 6 of section 3602 of the education law and the greater of: (i) the building aid ratio computed for use in the current year pursuant to subparagraph 4 of paragraph e of subdivision 3 of section 3602 of the education law; or (ii) a building aid ratio equal to the difference of the aid ratio that was used or that would have been used to compute an apportionment pursuant to subdivision 6 of section 3602 of the education law in the 1992-1993 school year, less one-tenth. SUMMARY OF PROVISIONS: Section one sets the calculation of building aid apportioned for the Shoreham-Wading River school district for any building project which aid is apportioned to pursuant to subdivision 6 of section 3602 at the greater of the following: the building aid ratio computed for use in the current year, or the building aid ration that would have been used in the 1992-93 school year. JUSTIFICATION: The current law allows schools districts to utilize the highest building aid ratio that has been apportioned to the school :from 1981 to the present, as long as the State Education Department has data on file by July 1 at least three years after the building aid ratio was utilized. In order to utilize a building aid ratio, school districts must incur debt for building projects.
