BILL NUMBER: S5242 TITLE OF BILL : An act to amend the penal law, in relation to assaulting a retired police officer PURPOSE : Creates a new assault crime for assault on a retire police officer. SUMMARY OF PROVISIONS : §1 - amends section 120.10 of the penal law by adding a new subdivision 5 - creating the crime of assault in the first degree when a person intentionally causes serious physical injury to a retired police officer. This would be a class B felony. §2 - the bill will take effect on the ninetieth day after it shall have become law. JUSTIFICATION : This bill stems from the blatant, premeditated assault of a retired police officer in Queens during June of 2007. The assault on retired police Captain Charles Stravelle occurred in Rego Park, Queens as Captain Stravelle and his family were getting takeout dinner at a local restaurant. The assailant cornered the Captain Stravelle and beat him in the head, legs, chest and arms before leaving him in a semi-conscious state. SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to assaulting a retired police officer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 120.10 of the penal law is amended by adding a new subdivision 5 to read as follows: 5. WITH INTENT TO CAUSE SERIOUS PHYSICAL INJURY, HE OR SHE INTEN- TIONALLY SELECTS A RETIRED POLICE OFFICER, AS POLICE OFFICER IS DEFINED PURSUANT TO SUBDIVISION THIRTY-FOUR OF SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW, AGAINST WHOM THE OFFENSE IS COMMITTED OR INTENDED TO BE COMMITTED IN WHOLE OR IN SUBSTANTIAL PART BECAUSE OF A BELIEF OR PERCEP- TION REGARDING SUCH RETIRED POLICE OFFICER'S INVOLVEMENT IN A PREVIOUS ARREST OF SUCH PERSON WHILE ON ACTIVE DUTY.
