BILL NUMBER: S5515 TITLE OF BILL : An act to amend the labor law, in relation to asbestos projects PURPOSE : To exempt municipalities from the payment of asbestos project notification fees when the project is funded by RESTORE monies. SUMMARY OF PROVISIONS : This bill would amend Labor Law Section 904 subdivision 2 to relieve contractors of municipalities performing asbestos projects which are funded in part by RESTORE monies from paying the project notification fee. JUSTIFICATION : Project notification fees for asbestos were doubled in the recently enacted budget. These increased fees adversely impact municipalities that are using RESTORE funding to remove vacant residential buildings. STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to asbestos projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 904 of the labor law is amended by adding a new closing paragraph to read as follows: EXCEPT THAT IN THE CASE OF A CONTRACTOR WHO IS LICENSED AND OTHERWISE COMPLIES WITH THE CERTIFICATION REQUIREMENTS OF THIS ARTICLE AND IS EMPLOYED BY A MUNICIPALITY WHICH IS FUNDING A PORTION OF AN ASBESTOS PROJECT WITH MONIES FROM THE RESTORE NEW YORK'S COMMUNITIES INITIATIVE PURSUANT TO SECTION SIXTEEN-N OF THE URBAN DEVELOPMENT CORPORATION ACT SUCH CONTRACTOR SHALL NOT BE REQUIRED TO PAY THE PROJECT NOTIFICATION FEE.
