BILL NUMBER: S6122 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to the graduated licensing program PURPOSE : This is a chapter amendment to A.8568-B relating to the prohibition on texting while driving. The chapter amendment removes the restriction on police and peace officers ability to issue a summons to an individual who they have reasonable cause to believe are texting while driving. SUMMARY OF PROVISIONS : Subdivision six of section 1225-d of the vehicle and traffic law as proposed in A.8568-B, which has passed both houses, is amended to remove a restriction on law enforcement's ability to issue a summons for a person the police have reasonable cause to believe are texting while driving. VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to the gradu- ated licensing program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 1225-d of the vehicle and traffic law, as added by a chapter of the laws of 2009, amending the vehicle and traffic law relating to the graduated licensing program, as proposed in legislative bills numbers S.3619-A and A.8568-B, is amended to read as follows: 6. A violation of this section shall be a traffic infraction and shall be punishable by a fine of not more than one hundred fifty dollars. [Provided, however, that a summons for operating a motor vehicle in violation of this section shall only be issued when there is reasonable cause to believe that the person operating such motor vehicle has committed a violation of the laws of this state other than a violation of this section.] S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2009, amending the vehicle and traf- fic law relating to the graduated licensing program, as proposed in legislative bills numbers S.3619-A and A.8568-B, takes effect.
