BILL NUMBER: S6206 TITLE OF BILL : An act to amend the public officers law, in relation to accident reports issued by the police department of the county of Suffolk PURPOSE OR GENERAL IDEA OF THE BILL : This legislation would allow Suffolk County to adopt legislation that would increase fees for the search and copy of accident reports and photographs. SUMMARY OF PROVISIONS : Section 1 adds a new subdivision which allows Suffolk County to adopt a local law to authorize the Suffolk County Police Department to charge fees for the search and copy of accident reports and photographs. Search fees would be set at $10 per accident report with no fee for photocopying such report. An additional fee of $10 shall be charged for a certified copy of any accident report, while a $15 fee will be charged per photograph or contact sheet. This section also states that investigative reports shall be charged at the same rate of accident reports which are set at $10. Section 2 is the effective date. JUSTIFICATION :

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public officers law, in relation to accident reports issued by the police department of the county of Suffolk THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 66-a of the public officers law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING THE PROVISIONS OF SECTION TWENTY-THREE HUNDRED SEVEN OF THE CIVIL PRACTICE LAW AND RULES, THIS CHAPTER, OR ANY OTHER LAW TO THE CONTRARY, THE COUNTY OF SUFFOLK, UPON ADOPTION OF A LOCAL LAW, IS HEREBY AUTHORIZED TO REQUIRE THE POLICE DEPARTMENT OF THE COUNTY OF SUFFOLK TO CHARGE FEES FOR THE SEARCH AND COPY OF ACCIDENT REPORTS AND PHOTOGRAPHS. A SEARCH FEE OF TEN DOLLARS PER ACCIDENT REPORT SHALL BE CHARGED, WITH NO ADDITIONAL FEE FOR A PHOTOCOPY. AN ADDITIONAL FEE OF TEN DOLLARS SHALL BE CHARGED FOR A CERTIFIED COPY OF ANY ACCIDENT REPORT. A FEE OF FIFTEEN DOLLARS PER PHOTOGRAPH OR CONTACT SHEET SHALL BE CHARGED.
