BILL NUMBER: S6757 TITLE OF BILL : An act to amend the public health law, in relation to excluding money raised by fundraising for volunteer emergency medical services when allocating state funding PURPOSE OR GENERAL IDEA OF BILL : This bill allows program agencies such as public Agencies that provide Emergency Medical Services the opportunity to raise and accept funding through sources other than state agency reimbursement, without jeopardizing the acquisition to state agency full funding. SUMMARY OF SPECIFIC PROVISIONS : Section 1. Amends the public health law, adding a new section 3005-6 which prohibits fundraising activity by (EMS) Emergency Medical Service units to be considered when determining state aid or reimbursement for services. Section 2. Establishes an immediate effective date for this act. JUSTIFICATION : Public agencies such as Emergency Medical Services have not seen a reimbursement rate increase under current law in approximately 15 years. EMS units are also not currently able to raise funds without

AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to excluding money raised by fundraising for volunteer emergency medical services when allocating state funding THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3005-c to read as follows: S 3005-C. FUNDRAISING BY VOLUNTEER AMBULANCE COMPANIES. 1. FOR PURPOSES OF THIS SECTION A "FUNDRAISING ACTIVITY" MEANS A METHOD OF RAISING FUNDS TO EFFECTUATE THE LAWFUL PURPOSES OF A VOLUNTEER AMBULANCE COMPANY, BUT SHALL NOT INCLUDE ANY METHOD PROHIBITED BY THE STATE CONSTITUTION OR THE PENAL STATUTES OF THIS STATE, OR THE CONDUCT OF A BUSINESS OR OTHER COMMERCIAL ENTERPRISE EXCEPT ON TEMPORARY BASIS FOR A PERIOD OR PERIODS NOT TO EXCEED A TOTAL OF NINETY DAYS IN ANY CALENDAR YEAR. 2. MONIES GENERATED FROM FUNDRAISING ACTIVITIES SHALL NOT BE CONSID- ERED WHEN DETERMINING STATE AID OR REIMBURSEMENT FOR SERVICES TO PARTIC- IPATING VOLUNTEER AMBULANCE COMPANIES. S 2.
