BILL NUMBER: S7087 TITLE OF BILL : An act to amend the environmental conservation law, in relation to the use of pesticides by commercial applicators PURPOSE OR GENERAL IDEA OF BILL : This bill seeks to allow for commercial pesticide applicators in a dosage, concentration or frequency less than that specified on the labeling. SUMMARY OF SPECIFIC PROVISIONS : Section 33-0725 of the Environmental Conservation Law is amended to add commercial applicators. Section 2 - Effective date. JUSTIFICATION : Currently, pesticides registered for use in New York State may be used for agricultural purposes only in a dosage, concentration or frequency less than that specified on the labeling, but commercial pesticide applicators may not. By allowing commercial applicators to apply less than label rates, the total amount of pesticides being applied in New York State will be decreased, providing economic and environmental benefits to the people of the state.

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conser- vation AN ACT to amend the environmental conservation law, in relation to the use of pesticides by commercial applicators THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 33-0725 of the environmental conservation law, as added by chapter 648 of the laws of 1998, is amended to read as follows: S 33-0725. Approved agricultural AND COMMERCIAL uses. A pesticide shall be used in accordance with its labeling. Unless the labeling specifically prohibits such use, a pesticide registered for use in New York state may be used for ONLY agricultural purposes [only] OR BY ONLY COMMERCIAL APPLICATORS in a dosage, concentration or frequency less than that specified on the labeling. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10682-01-9
