BILL NUMBER:S8432 TITLE OF BILL: An act to amend the general municipal law, in relation to authorizing reduced rates for water charged to laundry businesses PURPOSE: Authorizes reduced rates for water charged to laundry businesses. SUMMARY OF PROVISIONS: Section 1. The general municipal law is amended by adding a new section 118-d. Laundries; reduced water rates. JUSTIFICATION: Local businesses and residents are already struggling in this tough economy and with higher water rates everyone will feel the burden of an already tight budget. This is especially true of businesses such as laundries with a high water usage/waste water disposal necessity. These increases will inevi- tably have a trickle down affect. Businesses will have to raise costs to the consumer and there is a real possibility that additional increases could end with the need for layoffs and even business closures. ADAMS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general municipal law, in relation to authorizing reduced rates for water charged to laundry businesses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 118-d to read as follows: S 118-D. LAUNDRIES; REDUCED WATER RATES. 1. FOR PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: A. "USE WATER EXCLUSIVELY" SHALL MEAN THE USE OF WATER FOR WHICH NOT LESS THAN NINETY PERCENT OF SUCH USE IS USED FOR THE PURPOSE OF OPERAT- ING A LAUNDRY; B. "LAUNDRY" SHALL MEAN A COIN-OPERATED LAUNDRY, DRY CLEANER OR ANY OTHER ENTITY THAT PROVIDES FOR THE LAUNDERING OF CLOTHES ON THE PREM- ISES; C. "MUNICIPALITY" SHALL MEAN A COUNTY, TOWN, CITY OR VILLAGE; D. "WATER AUTHORITY" SHALL MEAN ANY WATER AUTHORITY ESTABLISHED PURSU- ANT TO THE LAWS OF THIS STATE. 2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY WATER AUTHORITY, MUNICIPALITY OR OTHER ENTITY WHICH SUPPLIES WATER TO CONSUMERS IN THIS STATE MAY, BY THE ADOPTION OF A RESOLUTION OR SIMILAR ACT, PROVIDE FOR A REDUCED RATE FOR WATER CHARGED TO BUSINESS CONSUMERS WHO USE WATER EXCLUSIVELY FOR THE PURPOSE OF OPERATING A LAUNDRY. SUCH REDUCTION IN WATER RATES SHALL NOT EXCEED FIFTEEN PERCENT OF THE STANDARD RATE CHARG- ES TO SUCH CONSUMERS. S 2. This act shall take effect immediately.
