BILL NUMBER:A10042 TITLE OF BILL: An act to amend the social services law, in relation to a state managed medical assistance demonstration project PURPOSE OF THE BILL: This bill would create a new demonstration project with up to three counties in which the Department of Health will completely take over the management and funding of medical assistance in the counties which participate in the project. SUMMARY OF SPECIFIC PROVISIONS: Section 1 - adds a new section 364-m of the Social Services Law to create a managed medical assistance demon- stration project. Under the project, up to three county social services departments interested in participating will be chosen by the Department of Health. The Department of Health will assume all of the duties of intake, management and related services for persons in need of such care. In return, the Department shall receive all of the funds that otherwise would have been paid to the local district to provide such duties by the state or federal government, and shall pay one hundred percent of the non-federal share of any payments made for such services. The project shall begin April 1, 2010, or as soon thereafter as a local district shall have applied and been approved by the Department of Health, and shall end March 31, 2013. SCHIMMINGER -- read once and referred to the Committee on Health AN ACT to amend the social services law, in relation to a state managed medical assistance demonstration project THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The social services law is amended by adding a new section 364-m to read as follows: S 364-M MANAGED MEDICAL ASSISTANCE DEMONSTRATION PROJECT. 1. NOTWITH- STANDING ANY PROVISION OF LAW TO THE CONTRARY, THERE IS HEREBY CREATED A DEMONSTRATION PROJECT WITHIN THE DEPARTMENT OF HEALTH TO ASSESS MEDICAL ASSISTANCE METHODOLOGIES AND DELIVERY METHODS IN CONJUNCTION WITH THE PROVISION OF MEDICAL ASSISTANCE. AS PART OF THE DEMONSTRATION PROJECT, A SELECTED LOCAL DISTRICT SHALL TRANSFER ALL INTAKE, MANAGEMENT AND RELATED SERVICES FOR PERSONS IN NEED OF SUCH CARE TO THE DEPARTMENT OF HEALTH. 2. THE DEPARTMENT OF HEALTH MAY APPROVE UP TO THREE LOCAL DISTRICTS AS A PART OF THE DEMONSTRATION PROJECT. 3. THE DEPARTMENT OF HEALTH SHALL RECEIVE ALL FUNDS THAT OTHERWISE WOULD HAVE BEEN PAID TO THE LOCAL DISTRICT FROM THE STATE FOR SERVICING AND MANAGEMENT FUNCTIONS TO REIMBURSE THE DEPARTMENT'S COSTS IN PROVID- ING SUCH SERVICES, AS WELL AS ALL FUNDS PROVIDED BY THE FEDERAL GOVERN- MENT FOR SUCH MANAGEMENT AND SERVICES AND SHALL PAY ONE HUNDRED PER CENTUM OF THE NON-FEDERAL SHARE OF ANY PAYMENTS MADE FOR THOSE SERVICES. 4. THE DEMONSTRATION PROJECT SHALL BEGIN APRIL FIRST, TWO THOUSAND TEN, OR AS SOON THEREAFTER AS A LOCAL DISTRICT SHALL HAVE APPLIED AND BEEN APPROVED AND END MARCH THIRTY-FIRST, TWO THOUSAND THIRTEEN. 5. ON OR BEFORE DECEMBER THIRTY-FIRST, TWO THOUSAND TWELVE, THE COMMISSIONER OF HEALTH SHALL SUBMIT TO THE GOVERNOR, THE TEMPORARY PRES- IDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY, A REPORT AS TO THE COSTS AND SAVINGS OF THE DEMONSTRATION PROJECT WITH RECOMMENDATIONS FOR ESTABLISHING A PERMANENT STATEWIDE CENTRAL MANAGED MEDICAL ASSISTANCE PROGRAM.
