S T A T E O F N E W Y O R K ________________________________________________________________________ 11508 I N A S S E M B L Y June 18, 2010 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Hoyt) -- read once and referred to the Committee on Ways and Means AN ACT to amend the state finance law, in relation to the adoption of the DUNS number as a mandatory vendor identifier for all New York state contractors and the establishment of a mandatory, central vendor registration portal THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 169 to read as follows: S 169. DUNS NUMBER AND CENTRAL VENDOR PORTAL. 1. FOR THE PURPOSES OF REDUCING GOVERNMENT COSTS, IMPROVING TRANSPARENCY AND PROVIDING FAIR OPPORTUNITY FOR ECONOMIC PROSPERITY TO ALL BUSINESSES REGARDLESS OF SIZE OR ETHNICITY, THE OFFICE OF THE STATE COMPTROLLER, IN CONJUNCTION WITH THE OFFICE OF GENERAL SERVICES AND THE DIVISION OF BUDGET, SHALL: A. REQUIRE THAT CONTRACTORS SELECTED TO OFFER CENTRALIZED CONTRACTS THROUGHOUT THE STATE FOR COMMODITIES, SERVICES OR TECHNOLOGY AND ANY GRANTEES OF SUCH CENTRALIZED CONTRACTS SHALL HAVE A DUNS NUMBER; B. CREATE A MANDATORY, CENTRAL DATABASE OF ALL NEW YORK STATE VENDORS, WHICH SHALL HOUSE DUNS NUMBERS AND FACILITATE DATA SHARING, COST SAVINGS, ADMINISTRATIVE EFFICIENCY AND TRANSPARENCY; C. ESTABLISH A CENTRAL VENDOR PORTAL; D. ESTABLISH A SINGLE, AUTHORITATIVE, PUBLICLY-AVAILABLE WEBSITE FOR REPORTING ALL NEW YORK STATE GOVERNMENT CONTRACTS AND GRANTS. STATE AGENCIES SHALL REPORT ALL CONTRACT AND GRANT ACTIONS TO THIS SITE IN A TIMELY MANNER, USING THE DUNS NUMBER AS THE IDENTIFIER TO IMPROVE DATA INTEGRITY; AND E. REQUIRE A DUNS NUMBER FOR ALL STATE CONTRACTORS AND GRANTEES TO ASSIST WITH COMPLIANCE WITH THE AMERICAN RECOVERY AND REINVESTMENT ACT (2009 PUB. L. 111-5) AND TO REDUCE COSTS AND IMPROVE TRANSPARENCY TO NEW YORK TAXPAYERS. 2. FOR THE PURPOSES OF THIS SECTION: A. "DUNS NUMBER" SHALL MEAN A UNIQUE NUMERIC IDENTIFIER ASSIGNED TO A SINGLE BUSINESS ENTITY PURSUANT TO THE DATA UNIVERSAL NUMBERING SYSTEM. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
