2009-A4014 (ACTIVE) - Summary

Provides that counties shall assist certain facilities in the preparation of disaster plans; whereby, each county in cooperation with the disaster preparedness commission shall provide assistance and advice for the development of such plans for each and every licensed facility within such county that treats or cares for any person; provides that such facilities shall include, but not be limited to, nursing homes, extended care facilities, and day care facilities; provides that the director of each facility shall maintain a copy of such plans on the premises of such facility at all times, and shall provide the disaster preparedness commission with the necessary addresses and phone numbers of such facility to allow the disaster preparedness commission to assist in the coordination of assistance.

AN  ACT to amend the executive law, in relation to requiring counties to
  provide assistance and advice to  licensed  care  facilities  to  help
  establish disaster preparedness plans

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 23 of the executive law is amended by adding a  new
subdivision 8 to read as follows:
  8.  CONSISTENT  WITH  THE  PROVISIONS  OF THIS SECTION, EACH COUNTY IN
COOPERATION WITH THE  DISASTER  PREPAREDNESS  COMMISSION  SHALL  PROVIDE
ASSISTANCE  AND  ADVICE  FOR  THE DEVELOPMENT OF SUCH PLANS FOR EACH AND
EVERY LICENSED FACILITY WITHIN SUCH COUNTY THAT TREATS OR CARES FOR  ANY
PERSON.  SUCH  FACILITIES  SHALL INCLUDE, BUT NOT BE LIMITED TO, NURSING
HOMES, EXTENDED CARE FACILITIES, AND DAYCARE FACILITIES. THE DIRECTOR OF
EACH FACILITY SHALL MAINTAIN A COPY OF SUCH PLANS  ON  THE  PREMISES  OF
EACH  FACILITY AT ALL TIMES, AND SHALL PROVIDE THE DISASTER PREPAREDNESS
COMMISSION WITH THE NECESSARY ADDRESSES AND PHONE NUMBERS OF SUCH FACIL-
ITIES TO ALLOW THE DISASTER PREPAREDNESS COMMISSION  TO  ASSIST  IN  THE
COORDINATION OF ASSISTANCE.
  S 2. This act shall take effect immediately.
