AN ACT to amend the environmental conservation law, in relation  to  the
  sale of DEET

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1  of  section  33-1301  of  the  environmental
conservation  law  is  amended  by  adding  a new paragraph f to read as
follows:
  F. END USE PRODUCT FORMULATIONS FOR USE ON HUMANS OF DEET  (N,  N-DIE-
THYL-M-TOLUAMIDE)  WITH  CONCENTRATIONS  OF  DEET WHICH ARE GREATER THAN
THIRTY PERCENT,  EXCEPT  CONTROLLED-RELEASE  FORMULATIONS  (FORMULATIONS
WHICH  CONTAIN  ONE OR MORE INGREDIENTS INTENDED TO REGULATE THE RATE OF
RELEASE OF ACTIVE INGREDIENTS) WHICH ARE GREATER THAN  THIRTY-THREE  AND
THIRTY-THREE HUNDREDTHS PERCENT OR MORE OF DEET ACTIVE INGREDIENTS.
  S 2. This act shall take effect on the one hundred twentieth day after
it  shall  have  become a law; provided, however, that any rule or regu-
lation necessary for the timely implementation of this act on its effec-
tive date may be promulgated on or before such date.
