S T A T E O F N E W Y O R K ________________________________________________________________________ 4258 2009-2010 Regular Sessions I N A S S E M B L Y February 2, 2009 ___________ Introduced by M. of A. CROUCH -- read once and referred to the Committee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the economic development law, in relation to authorizing the department of economic development to provide funding for economic development in Delaware county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The economic development law is amended by adding a new article 15 to read as follows: ARTICLE 15 ECONOMIC DEVELOPMENT IN DELAWARE COUNTY SECTION 300. ECONOMIC DEVELOPMENT IN DELAWARE COUNTY. S 300. ECONOMIC DEVELOPMENT IN DELAWARE COUNTY. 1. THE DEPARTMENT SHALL, FOR EACH FISCAL YEAR COMMENCING APRIL FIRST, TWO THOUSAND TEN, PROVIDE FUNDING IN THE AMOUNT OF FIFTY THOUSAND DOLLARS EACH FOR THE COUNTY OF DELAWARE. SUCH FUNDING SHALL BE UTILIZED BY SUCH COUNTY TO FUND A POSITION RELATED TO THE ECONOMIC DEVELOPMENT OF THAT COUNTY. 2. DELAWARE COUNTY MAY NOT UTILIZE SUCH FUNDING FOR ANY OTHER PURPOSE EXCEPT AS PROVIDED IN THIS SECTION NOR SHALL SUCH COUNTY DIMINISH THE EMPLOYMENT OF PERSONS WHO ARE CURRENTLY UNDERTAKING ECONOMIC DEVELOPMENT RELATED ACTIVITIES; PROVIDED HOWEVER THAT SUCH COUNTY MAY DIMINISH SUCH EMPLOYMENT IF IT DEMONSTRATES TO THE SATISFACTION OF THE COMMISSIONER THAT SUCH DIMINISHMENT WOULD HAVE OCCURRED IRRESPECTIVE OF THE PROVISIONS OF THIS SECTION. 3. ANY PERSON HIRED UNDER THIS SECTION SHALL BE TRAINED IN STATE ASSISTANCE AND OTHER PROGRAMS AVAILABLE TO DELAWARE COUNTY WHICH WOULD ENCOURAGE ECONOMIC DEVELOPMENT. 4. FOR ALL PURPOSES, INCLUDING, BUT NOT LIMITED TO THE PURPOSES IN THE RETIREMENT AND SOCIAL SECURITY LAW, ANY PERSON HIRED UNDER THIS SECTION SHALL BE DEEMED AN EMPLOYEE OF DELAWARE COUNTY AND THE STATE SHALL HAVE NO LIABILITY IN ANY CIVIL OR CRIMINAL ACTION FOR ANY ACTION UNDERTAKEN BY THE EMPLOYEE IN HIS OR HER POSITION PROVIDED FOR UNDER THIS SECTION. S 2. This act shall take effect immediately.
