AN ACT to amend chapter 326 of the laws of  2008,  amending  the  family
  court  act,  the criminal procedure law and the judiciary law relating
  to orders of protection and the definition of  "members  of  the  same
  family  or  household",  in  relation to making a technical correction
  thereto

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 16 of chapter 326 of the laws of 2008, amending the
family  court  act,  the  criminal  procedure  law and the judiciary law
relating to orders of protection and the definition of "members  of  the
same family or household", is amended to read as follows:
  S 16. This act shall take effect immediately and shall apply to orders
of  protection  pending  or  entered  on  or after such effective date[,
except]; PROVIDED, that:
  (A) section [fourteen] THIRTEEN of this act shall expire and be deemed
repealed September 1, 2010; [provided that]; AND
  (B) the amendments to paragraph (n) of subdivision 2 of section 212 of
the judiciary law, made by section  thirteen  of  this  act,  shall  not
affect  the  expiration and repeal of such paragraph and shall be deemed
repealed therewith, IF  SECTION  THIRTEEN  OF  THIS  ACT  HAS  NOT  BEEN
REPEALED PRIOR THERETO.
  S 2. This act shall take effect immediately.
