TITONE, TOBACCO -- read once and referred to the Committee on Governmental Employees AN ACT to authorize the designated beneficiary or beneficiaries of Leonard Feder to receive a death benefit equal to three times his salary without reduction based on mortality THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, the beneficiary or beneficiaries of Leonard Feder, who was a member of the New York state and local employees' retirement system and was employed by the division of lottery upon his death on October 28, 2006 at the age of 83 years, shall be entitled to receive a death benefit equal to such member's salary multiplied by three, less death benefits previously paid to his beneficiary or beneficiaries, if, on or before December 31, 2009, such beneficiary or beneficiaries shall file an application therefor with the state comptroller. S 2. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill would grant an increase in the death benefit payment to the beneficiary of Leonard Feder, a former member of the New York State Employees' Retirement System who was employed by the division of lottery until his death on October 28, 2006 at the age of 83 years. If this bill is enacted, there will be an immediate past service cost of approximately $78,100 which would be shared by the State of New York and all the participating employers in the New York State and Local Employees' Retirement System. This estimate, dated January 30, 2009, and intended for use only during the 2009 Legislative Session, is Fiscal Note No. 2009-126, prepared by the Actuary for the New York State and Local Employees' Retirement System.
