LOPEZ, PHEFFER, ROBINSON, WRIGHT -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to providing the families of the world trade center victims with health benefits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 369-ee of the social services law is renumbered subdivision 8 and a new subdivision 7 is added to read as follows: 7. NOTWITHSTANDING ANY INCONSISTENT PROVISIONS OF LAW, AN INDIVIDUAL WHO MEETS THE ELIGIBILITY REQUIREMENTS OF SUBPARAGRAPHS (I), (II) OR (III) OF PARAGRAPH (A) OF SUBDIVISION TWO OF THIS SECTION AND IS A SURVIVING VICTIM OF THE WORLD TRADE CENTER ATTACK OF SEPTEMBER ELEVENTH, TWO THOUSAND ONE, OR A SURVIVING SPOUSE OR DEPENDENT OF A DECEASED VICTIM, MAY ENROLL AND RECEIVE HEALTH CARE SERVICES PURSUANT TO THE PROVISIONS OF THIS SECTION; PROVIDED, HOWEVER, THAT THE ELIGIBLE ORGAN- IZATION THROUGH WHICH THE INDIVIDUAL ENROLLS SHALL NOT BE ELIGIBLE TO RECEIVE A SUBSIDY FOR PROVIDING SUCH COVERAGE TO SUCH INDIVIDUAL OR SUCH INDIVIDUAL'S FAMILY. THE COST OF SUCH INDIVIDUAL'S COVERAGE SHALL BE DETERMINED BY THE COMMISSIONER, IN CONSULTATION WITH THE SUPERINTENDENT OF INSURANCE, AND THE REIMBURSEMENT TO SUCH ELIGIBLE ORGANIZATION SHALL BE NO MORE THAN THE COST OF PROVIDING SUCH COVERAGE. S 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after March 1, 2003.
