2009-A7458 (ACTIVE) - Summary

Permits a state agency to extend the last date for submission of comments on a proposed rule by publishing notice of extension in the state register; provides that any citizen or resident may ask for such an extension, and if asked for by the state comptroller, the attorney-general, or a member of the legislature, the agency shall either grant or deny the request and, if denied, state its reasons in writing.

AN ACT to amend the state administrative procedure act, in  relation  to
  notice of proposed rule making

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (a) of subdivision 1 of section 202 of the  state
administrative  procedure  act  is amended by adding a new closing para-
graph to read as follows:
  AFTER PUBLICATION OF THE INITIAL NOTICE OF PROPOSED  RULE  MAKING,  AN
AGENCY  MAY  EXTEND  THE  LAST  DATE  FOR  SUBMISSION OF COMMENTS ON THE
PROPOSED RULE BY PUBLISHING NOTICE OF THE EXTENSION IN THE STATE  REGIS-
TER.  ANY  CITIZEN  OR  RESIDENT  OF NEW YORK STATE MAY ASK AN AGENCY TO
EXTEND A COMMENT PERIOD. WHEN SUCH A REQUEST IS MADE BY THE STATE  COMP-
TROLLER, THE ATTORNEY GENERAL, OR A MEMBER OF THE LEGISLATURE, THE AGEN-
CY  SHALL  EITHER  GRANT  THE  REQUEST, OR DENY THE REQUEST AND STATE IN
WRITING ITS REASONS FOR DENYING THE REQUEST.
  S 2. This act shall take effect immediately.
